[value] => Wichtige Neuigkeiten für künftige Eltern: Am 1. April 2019 ist die Verlängerung der Dauer des Vaterschaftsurlaubs auf 8 Wochen in Kraft getreten, mit einer schrittweisen Erhöhung auf 16 Wochen bis zum Jahr 2021. Spanien, das in Bezug auf den Vaterschaftsurlaub bisher hinter anderen europäischen Ländern lag, will mit dieser Neuerung das Recht der Arbeitnehmer auf Vereinbarkeit von Privat-, Familien- und Berufsleben verbessern.
Der neue Vaterschaftsurlaub ersetzt die bisherige Regelung mit einer Dauer von 5 Wochen. Es handelt sich zudem um eine schrittweise Verlängerung, so dass Väter bis Ende 2019 über einen Vaterschaftsurlaub von 8 Wochen verfügen werden, von denen die ersten 2 Wochen ununterbrochen unmittelbar nach der Geburt genommen werden müssen, und die Mutter bis zu 4 Wochen ihres nicht zwingenden Mutterschutzurlaubs an den Vater abtreten kann. Während des Jahres 2020 werden Väter eine Vertragsunterbrechung von insgesamt 12 Wochen zur Verfügung haben, von denen die ersten 4 Wochen unmittelbar nach der Geburt genossen werden müssen und die Mutter bis zu 2 Wochen ihrer nicht zwingenden Vertragsunterbrechung auf den Vater übertragen kann. Ab 2020 steht jedem Elternteil der gleiche Anspruch auf 16 Wochen Vertragsunterbrechung zu, davon 6 aufeinanderfolgende Wochen unmittelbar nach der Geburt, die nicht nur für die Mutter, sondern auch für den Vater obligatorisch sind, und die in Vollzeit genommen werden müssen. Dieser Anspruch ist nicht übertragbar, so dass der Vater ihn nicht an die Mutter abtreten kann. Nach Ablauf der ersten 6 Wochen seit der Geburt, kann die Vertragsunterbrechung nach Vereinbarung mit dem Unternehmen in Vollzeit oder in Teilzeit genossen werden, und zusammenhängend oder unterbrochen aufgeteilt werden, bis das Kind zwölf Monate alt ist.
Diese “Gleichstellung der Elternzeit” stellt Spanien in Bezug auf die Ansprüche bei Vaterschaft den fortschrittlichsten Ländern gleich.

España, que siempre ha estado a la cola de otros países europeos en lo que al permiso de paternidad se refiere, pretende facilitar con esta novedad el derecho de los trabajadores a la conciliación de la vida personal, familiar y laboral.
El nuevo permiso de paternidad dejará de lado las 5 semanas de permiso reguladas hasta la fecha. Se trata además de una ampliación progresiva, por lo que hasta finales de 2019, el padre contará con un periodo de suspensión de 8 semanas, de las cuales las 2 primeras deberán ser disfrutadas de forma ininterrumpida inmediatamente tras el parto y la madre podrá cederle hasta 4 semanas de su periodo de suspensión de disfrute no obligatorio. Durante el año 2020, el padre contará con un periodo de suspensión total de 12 semanas, de las cuales las 4 primeras deberán ser disfrutadas de forma ininterrumpida inmediatamente tras el parto y la madre podrá cederle hasta 2 semanas de su periodo de suspensión de disfrute no obligatorio. Y, a partir de 2020, cada progenitor disfrutará de igual periodo de 16 semanas de suspensión del contrato, incluyendo 6 semanas ininterrumpidas inmediatamente posteriores al parto que son obligatorias, no solo para la madre, sino también para el padre, y habrán de disfrutarse a jornada completa. Asimismo, este permiso es intransferible, por lo que el padre no podrá cederlo a la madre. Transcurridas las primeras 6 semanas inmediatamente posteriores al parto, la suspensión del contrato podrá disfrutarse a jornada completa o parcial, previo acuerdo con la empresa, y podrá distribuirse de forma acumulada o interrumpida hasta que el hijo o la hija cumpla doce meses.
Esta “igualdad de permisos entre progenitores” equipara a España a los países más avanzados en lo que a prestaciones por paternidad respecta.
