[value] => Die bisherige gesetzliche Regelung aus §7 Abs. 3 Sätze 1 bis 3 des Bundesurlaubsgesetzes besagte, dass nicht beantragter und nicht genommer Urlaub mit Verstreichen des Kalenderjahres ersatzlos verfällt. Eine Ausnahme zu diesem Grundsatz wurde dann zugelassen, wenn dringende betriebliche oder persönliche Übertragungsgründe des Arbeitnehmers, die Verschiebung des Urlaubs rechtfertigten. Dann konnte der Urlaub bis spätestens zum 31. März des Folgejahres genommen werden.
In diesem Zusammenhang hat der EuGH über eine Vorlagefrage des BAG (C-684/16, Shimizu) und über eine weitere Anfrage des OVG Berlin-Brandenburg (C-619/16, Kreuziger) entschieden. Demnach verfällt der Mindesturlaub nicht allein deshalb, weil der Arbeitnehmer keinen Urlaub beantragt hat. Der Anspruch auf Urlaub bzw. Urlaubsabgeltung kann nach der neuen Entscheidung des EuGH nur dann verfallen, wenn der Arbeitnehmer vorab durch den Arbeitgeber in die Lage versetzt wird, seinen Urlaub rechtzeitig zu nehmen. Dies ist dann der Fall, wenn der Arbeitgeber den Arbeitnehmer zuvor konkret aufgefordert hat, den Urlaub zu nehmen, und ihn klar und rechtzeitig darauf hingewiesen hat, dass der Urlaub anderenfalls mit Ablauf des Urlaubsjahres oder Übertragungszeitraums erlischt. Im Streitfall trägt der Arbeitgeber die Beweislast dafür, dass er den Arbeitnehmer auf die Rechtsfolgen hingewiesen hat. Daher sollten Arbeitgeber ihre Arbeitnehmer in jedem Fall durch eine schriftlich Mitteilung in Kenntnis setzen.
Obwohl der Geseteztext des §7 Abs. 3 Sätze 1 bis 3 des Bundesurlaubsgesetzes unverändert bleibt, wird er in Zukunft von den Arbeitsgerichten anders interpretiert werden als bisher. Künftig soll den Arbeitgebern auch ein größerer Spielraum bei der Festlegung der Urlaubszeit eingeräumt werden. Um die Erfüllung von Urlaubsansprüchen zu garantieren, sollen Arbeitgeber künftig die Möglichkeit haben, Arbeitnehmer „in den Urlaub zu schicken“.

Se admitía como excepción a este principio, arrastrar las vacaciones, cuando por razones operativas de la empresa o motivos personales del empleado se justificaban. En tal caso, las vacaciones podrían disfrutarse hasta el 31 de marzo del año siguiente.
En este contexto, el TJCE se pronunció sobre dos cuestiones presentadas por el BAG (C-684/16, Shimizu) y el OVG Berlin-Brandenburg (C-619/16, Kreuziger). Falló que el derecho a un mínimo de cuatro semanas de vacaciones al año, no expira por falta de solicitud por parte del trabajador. Según la nueva sentencia del TJCE, el derecho a las vacaciones sólo se puede perder cuando el empresario previamente haya requerido a su trabajador al disfrute de sus vacaciones, y, además, haya informado sobre las consecuencias, es decir, la pérdida de vacaciones por no solicitarlas antes del transcurso del año natural o, en su caso, el 31 de marzo del año siguiente. La carga de la prueba recae sobre el empresario, quien debe demostrar que había informado debidamente al trabajador (sobre dichas consecuencias). Resulta por lo tanto recomendable que los empresarios informen a sus empleados por escrito sobre esta circunstancia.
Aunque el texto legal del §7.3 de la ley alemana sobre vacaciones se mantendrá sin cambios, a partir de ahora los tribunales laborales interpretarán de forma distinta su aplicación. En el futuro, los empresarios dispondrán probablemente de más flexibilidad a la hora de determinar el período de vacaciones de sus trabajadores. Para poder garantizar el cumplimiento del disfrute de vacaciones, puede que en el futuro los empresarios “deberán mandar a sus empleados de vacaciones”.
