[value] => Da zwischen der EU und dem Vereinigten Königreich kein Abkommen zustande kam, hat sich das Datum für einen geordneten Ausstieg auf den 31.10.2019 verschoben, mit einer Übergangsperiode bis zum 31. Dezember 2020, während der die EU-Rechtsvorschriften im Vereinigten Königreich im Bereich Binnenmarkt, Zollunion und gemeinschaftliche Politik weiterhin gelten.
Sollte zum Zeitpunkt des Ausstiegs kein Abkommen in Kraft treten, würde Großbritannien am Folgetag, d.h. am 1.11.2019, als Drittland gelten. Dies könnte beträchtliche Auswirkungen auf den europäischen Binnenmarkt haben, wie es die Steuerverwaltungsbehörde bekräftigt:
- Zollbereich: die Warenströme zwischen Spanien und dem Vereinigten Königreich würden nicht mehr als innergemeinschaftliche Transak-tionen, sondern als Aus- und Einfuhren von Waren betrachtet, und alle Zollformalitäten müssten daher erledigt werden.
- Mehrwertsteuer (MwSt.): der Warenversand von Spanien nach Großbritannien würde ab dem Zeitpunkt als Export gelten, der von der Mehrwertsteuer befreit ist. Die Zollerklärung (DUA/Einheitspapier) würde als glaubhaftes Beweismittel für eine solche Befreiung dienen. Einfuhren in das Vereinigte Königreich würden der Einfuhrumsatzsteuer unterliegen. Andererseits müssten sie nicht mehr in der Sammel-meldung, Formular 349, mitgeteilt werden, da der Warenverkehr zwischen beiden Ländern nicht mehr als innergemeinschaftlich betrachtet würde.
- Verbrauchsteuern: der Versand/Empfang von Waren, die der Verbrauchsteuer unterliegen, würde unter die Zollvorschriften der Union fallen. Die Softwareanwendung EMCS würde weder den Empfang noch den Versand von/an Großbritannien ermöglichen.

[value] => Ante la falta de acuerdo alcanzado entre la UE y el Reino Unido, se ha prorrogado la fecha para una salida ordenada hasta el 31.10.2019, estableciéndose un período transitorio hasta el 31 de diciembre de 2020., durante el que se seguirá aplicando la legislación comunitaria en el Reino Unido en relación al mercado interior, la unión aduanera y las políticas comunitarias.
Si en la fecha de salida no estuviese en vigor el acuerdo, el Reino Unido pasaría a tener la consideración de tercer país a partir del día siguiente, el 1.11.2019. Esto podría tener un efecto significativo en el mercado único europeo, tal como indica la Agencia Tributaria:
- Ámbito aduanero: los flujos de mercancías entre España y el Reino Unido dejarían de tener la consideración de operaciones intracomunitarias para pasar a considerarse Exportaciones o Importaciones de bienes, debiendo cumplir todas las formalidades aduaneras.
- Impuesto sobre el valor añadido (IVA): los envíos de mercancías desde España al Reino Unido pasarán a considerarse exportaciones y estarán exentos de IVA, siendo la declaración aduanera (DUA) uno de los medios de prueba admitidos a efectos de justificar dicha exención. Las importaciones realizadas en el Reino Unido estarán sujetas al IVA a la importación. Por otra parte, dado que las operaciones realizadas entre ambos países dejan de calificarse como intracomunitarias, no deberán informarse a través de la declaración recapitulativa, modelo 349.
- Impuestos especiales: las expediciones/recepciones de productos objeto de Impuestos Especiales estarán sujetas a la normativa aduanera de la Unión. La aplicación informática EMCS, no admitirá ni la recepción ni el envío de mensajes del/al Reino Unido.
