[value] => In einem neuen Urteil hat der Oberste Gerichtshof noch einmal die Bedeutung der Beschreibung privater Elemente in Urkunden der horizontalen Aufteilung von Gebäuden oder bei der Errichtung von Immobilienkomplexen betont. Es ist üblich, dass öffentliche Urkunden die wichtigsten privaten Elemente wie Häuser, Parkplätze.... beschreiben und
vergessen, andere, nicht so wichtige Elemente zu erwähnen. Das bedeutet, dass alle Elemente, die nicht ausdrücklich als privates Element festgelegt wurden, Teil der Eigentümergemeinschaft werden. Der Grund dafür liegt in der Vermutung der Gemeinschaft, die in unserem Rechtssystem verankert ist, und in der Tatsache, dass die in Artikel 396 des Bürgerlichen Gesetzbuches genannten gemeinsamen Elemente in einer ausdrücklichen und nicht einschränkenden Weise ausgelegt werden sollten. In diesem Sinne und in Bezug auf Immobilienkomplexe ist zu erwähnen, dass viele öffentliche Urkunden weder Vorhallen noch Veranden als private Elemente qualifizieren, so dass später in den meisten Fällen Diskussionen über die Modifikation solcher Elemente stattfinden.
Das oben genannte Urteil erwähnt auch die Notwendigkeit, private Immobilienkomplexe zu artikulieren, da sie als eine einzige Gemeinschaft - in diesem Fall ist die Vermutung der Gemeinschaft voll anwendbar -, aber auch als Gruppierung von Eigentümergemeinschaften gebildet werden können. In diesem zweiten Fall erstreckt sich die Zuständigkeit der gruppierten Gemeinschaft nur auf die Elemente, die sich ausdrücklich als gemeinsam qualifiziert haben, wodurch eine größere Verfügungsmacht über die übrigen Elemente gegenüber jeder der Eigentümergemeinschaften anerkannt wird, so dass die Entscheidung für die eine oder andere Form entsprechende Rechtswirkungen hat.

[value] => El Tribunal Supremo, en una reciente Sentencia, ha puesto de nuevo de manifiesto la importancia de describir adecuadamente los elementos privativos al otorgar las escrituras que dividen los edificios en régimen de propiedad horizontal o bien, que, en el caso de urbanizaciones, constituyen los complejos inmobiliarios privados. Tales escrituras a menudo se centran únicamente en describir los elementos privativos más relevantes (viviendas, locales u otros, como plazas de aparcamiento y/o trasteros), olvidando que nuestro ordenamiento establece la denominada presunción de comunidad.
En virtud de esta presunción, se consideran comunes todos los elementos que no hayan sido descritos como privativos, así como también aquéllos que no han sido mencionados de forma expresa en el título constitutivo. Y es que la enumeración de los elementos comunes que contiene el artículo 396 del Código Civil debe ser interpretada de un modo meramente enunciativo y no, limitativo. En el caso de los complejos inmobiliarios, resulta muy habitual, indicar que el “resto de la parcela” se destina a “zonas libres de paso y ajardinadas, zonas de recreo, piscinas y zonas de uso común”. Los porches o soportales suelen ser los grandes olvidados, surgiendo entonces a menudo disputas por la modificación de tales elementos.
La arriba indicada Sentencia, además, ha puesto de manifiesto la importancia a la hora de articular los complejos inmobiliarios privados ya que éstos pueden constituirse como una sola comunidad –en cuyo caso le será de plena aplicación la presunción de comunidad- pero también, como una agrupación de comunidades de propietarios. En este segundo caso, la competencia de la comunidad agrupada únicamente se extiende a los elementos que hayan sido expresamente calificados como comunes, reconociendo así una mayor facultad de disposición sobre el resto de elementos a cada una de las Comunidades de Propietarios, por lo que optar por una u otra forma tiene efectos jurídicos relevantes.
