[value] => Nach der Verabschiedung des Königlichen Gesetzesdekrets 6/2019 über „Dringende Maßnahmen zur Gewährleistung der Gleichbehandlung und der Chancengleichheit von Frauen und Männern in Beschäftigung und Beruf“ wurde ein weiterer Schritt im Hinblick auf die Gleichstellung von Männern und Frauen getan, indem die Verpflichtung zur Aufstellung von Gleichstellungsplänen auf Unternehmen mit 50 oder mehr Beschäftigten ausgedehnt wurde. In der Vergangenheit bestand diese Verpflichtung zur Verhandlung eines Gleichstellungsplans nur in Unternehmen mit mehr als 250 Mitarbeitern. Diese neue Verpflichtung wird schrittweise eingeführt:
- Ab dem 7.3.2020 muss ein solcher Gleichstellungsplan von Unternehmen mit mehr als 150 und bis zu 250 Mitarbeitern aufgestellt werden.
- Ab dem 7.3.2021 trifft diese Verpflichtung alle Unternehmen mit mehr als 100 und bis zu 150 Beschäftigten.
- Ab dem 7.3.2022 müssen Unternehmen mit 50 bis 100 Beschäftigten einen Gleichstellungplan aufstellen.
Die Maßnahmen und Ziele des Plans müssen bewertbar sein und der Inhalt desselben ist mit den Arbeitnehmervertretern zu verhandeln. Die Gleichstellungspläne müssen u.a. Fragen des Zugangs zur Beschäftigung, der beruflichen Einstufung, der Beförderung und Ausbildung, der Vergütung, der Arbeitszeitgestaltung im Hinblick auf die Gleichstellung von Frauen und Männern, die Vereinbarkeit von Beruf, Privatleben und Familie sowie die Verhütung von sexueller Belästigung und Belästigung aufgrund des Geschlechts beinhalten. Ebenso wird ein Register der Gleichstellungspläne geschaffen werden, in dem die Unternehmen ihre Pläne registrieren müssen; zudem sind die Arbeitgeber verpflichtet, ein Gehaltsregister zu führen, das nach Geschlecht und Berufsgruppen oder gleichwertigen Arbeitsplätzen gegliedert ist. Die Arbeitnehmer haben mittels ihrer Vertretung das Recht auf Zugang zu der in diesem Register enthaltenen Information. Zu beachten ist, dass die Nichteinhaltung der unternehmerischen Verpflichtungen in Bezug auf Gleichstellungspläne von der Arbeitsaufsichtsbehörde sanktioniert werden kann.
[summary] => [format] => full_html ) ) [x-default] => Array ( [0] => Array ( [value] =>Tras la aprobación del Real Decreto-Ley 6/2019 de “Medidas urgentes para garantía de la igualdad de trato y de oportunidades entre mujeres y hombres en el empleo y la ocupación”, se da un paso adelante con las obligaciones en materia de igualdad entre hombres y mujeres, pues se extiende la exigencia de redacción de los planes de igualdad a empresas de 50 o más trabajadores. Cabe recordar que anteriormente solo era obligatorio negociarlo en empresas de más de 250 empleados. Esta nueva obligación de aprobar un plan de igualdad se irá integrando de forma progresiva:
- A partir del 7.3.2020, deberán aprobarlo las empresas con más de 150 y hasta 250 personas trabajadoras.
- A partir del 7.3.2021, deberán aprobarlo las empresas con más de 100 y hasta 150 personas trabajadoras.
- A partir del 7.3.2022, deberán aprobarlo las empresas de entre 50 a 100 personas trabajadoras.
Se regula que las medidas y objetivos del plan han de ser evaluables y que el contenido debe ser negociado con los representantes de los trabajadores. Para la consecución de los objetivos fijados, los planes de igualdad deberán contemplar y tratar, entre otras, las materias de acceso al empleo; clasificación profesional; promoción y formación; retribuciones; ordenación del tiempo de trabajo para favorecer, en términos de igualdad entre mujeres y hombres, la conciliación laboral, personal y familiar, y prevención del acoso sexual y del acoso por razón de sexo. Asimismo, se creará un Registro de Planes de Igualdad de las Empresas, en el cual las empresas tendrán que inscribir sus planes de igualdad y el empresario está obligado a llevar un registro salarial desglosado por sexo y grupos profesionales o puestos de trabajo iguales o de igual valor. A través de la representación legal, los trabajadores tendrán derecho a acceder a la información contenida en este registro. No debe olvidarse que el incumplimiento de las obligaciones relativas a los planes y medidas de igualdad podrá ser sancionado por la Inspección de Trabajo.
