[value] => Die dritte Kammer des Landgerichts Córdoba hat ein Urteil gefällt, in dem ein Notar für die fortgesetzte Tat der Unterschlagung zu 4 Jahren Haft verurteilt wurde. Er wurde nicht nur zur Zahlung einer Geldstrafe in Höhe von 30.000 € verurteilt, sondern muss auch alle Geschädigten in der Höhe entschädigen, die er unterschlagen hat. Die Gesamtsumme der Entschädigungen beläuft sich auf 400.920,39 €.
Das Gericht stellt in seinem Urteil fest, dass die genannten Summen zwischen 2009 und 2015 von den Klienten „in dem Vertrauen, das die übliche Führung eines Notariats genießt“ übergeben wurden. Der Angeklagte nutzte das Vertrauen seiner Klienten aus und verwirklichte schließlich seinen Plan, indem er eine Firma benutzte, dessen Unternehmenszweck die Beratung und Einreichung bestimmter Dokumente bei bestimmten Organen war. Durch diese Firma erhielt er von unterschiedlichen Personen und Gesellschaften Geldsummen als Kostenvoranschlag für die Erstellung von Urkunden, die Festsetzung von Steuern, für Protokolle, für die Zahlung von Gebühren oder für Grundbucheintragungen. Er erhielt diese Summen in bar, als Bankscheck oder mittels Überweisung. Der Angeklagte nutzte die Summen, die ihm anvertraut worden waren hingegen zu einem anderen Zweck, der eigenen Bereicherung. Der Richter sah es als bewiesen an, dass sich der Notar der ihm anvertrauten Summen bemächtigt hatte, um sich illegal zu bereichern, da er die beauftragten Tätigkeiten letztlich nicht ausführte.
Die Ehefrau des Angeklagten sprach das Gericht jedoch frei, da „weder nachgewiesen werden konnte, dass sie an der Ausführung der Taten beteiligt war, noch, dass sie aus den durch ihren Ehemann unterschlagenen Summen einen Nutzen zog.“

[value] => La sección tercera de la Audiencia Provincial de Córdoba ha dictado una sentencia por la que se condena a cuatro años de cárcel a un notario por la comisión de un delito continuado de apropiación indebida. Además del pago de una multa de 30.000 euros, deberá indemnizar a todos los perjudicados en la cantidad de la que se apropió y que en total ascendía al importe de 400.920,39 euros.
El tribunal manifiesta en su fallo que dichas cantidades fueron entregadas entre los años 2009 y 2015 por los clientes “desde la confianza que infunde la práctica usual de cualquier notaría”. El acusado, aprovechándose de la confianza de sus clientes, logró materializar su plan utilizando a una empresa cuyo objeto social era el asesoramiento y la tramitación de documentos ante distintos organismos. Gracias a esta empresa, recibió de distintos particulares y sociedades cantidades de dinero como provisión de fondos - en metálico, por cheque bancario o a través de transferencias - para la realización de escrituras, liquidaciones de impuestos, actas, pago de tasas o inscripciones en el Registro de la Propiedad. Sin perjuicio de ello, el acusado destinó las cantidades que le habían sido entregadas a otro fin, en concreto, al beneficio particular. El juzgador consideró probado que el notario se había apropiado de las cantidades que le habían sido entregadas con ánimo de enriquecimiento ilícito, puesto que no llegó a ejecutar todos los trabajos encomendados.
Por el contrario, el tribunal, absuelve a la esposa del acusado, al entender que “no ha resultado acreditado que participara en la ejecución de los hechos ni se beneficiase de las cantidades apropiadas por su marido”.
