[value] => Am vergangenen 9. Mai veröffentlichte das spanische Finanzministerium den Entwurf des Königlichen Dekrets, der Änderungen an der Abgabenordnung für die Einkommensteuer für Nichtresidente (IRNR) vornimmt. Ziel dieser Änderung ist nichts geringeres als die Festlegung der Möglichkeiten des Nachweises der steuerlichen Ansässigkeit, um die Schwierigkeiten zu vermeiden, die sich bei in anderen EU-Mitgliedsstaaten ansässigen Rentenfonds und Investmentvermögen (sogenannte Collective Investment Vehicle) bei der Anwendung der Steuerbefreiung aus Art. 14 des Königlichen Gesetzesdekrets 5/2004, durch welches die Neufassung des IRNR-Gesetzes erlassen wird, stellen.
Die Körperschaften, deren Einkünfte Gegenstand der Steuerbefreiung sein sollen und die ihre Ansässigkeit in dem entsprechenden EU-Mitgliedsstaat nachweisen müssen, sind folgende: a) Rentenfonds, die den in der Neufassung des Gesetzes zu Pensionsplänen und -fonds geregelten gleichwertig sind, b) Investmentvermögen gemäß der EG-Richtlinie 2009/65/EG und c) andere Investmentvermögen, die einem Genehmigungssystem unterliegen. Das eingesetzte Verfahren hängt davon ab, ob die Körperschaften, die die Steuerbefreiung geltend machen wollen, als steuerlich transparente Körperschaften (sogenannte Flow-Through Entities) betrachtet werden.
Falls zutreffend, findet die Steuerbefreiung der erwirtschafteten Einkünfte auf ihre Mitglieder Anwendung, die in einem anderen EU-Mitgliedsstaat ansässig sind. Der Nachweis über die Ansässigkeit erfolgt gemäß den Bestimmungen der EU-Richtlinie 2011/16/EU, Anhänge I und II. Falls nicht zutreffend, erfolgt der Nachweis für Rentenfonds mittels einer Erklärung durch ihren Vertreter, bei Investmentvermögen mittels Bescheinigung, die durch die zuständige Behörde des entsprechenden Mitgliedsstaates ausgestellt wird. Diese Maßnahme sollte gut aufgenommen werden, da sie die tatsächliche Anwendung der Steuerbefreiung für solche Arten von Einkünften in Spanien erleichtert.

[value] => El pasado 9 de mayo se publicó por el Ministerio de Hacienda el Proyecto de Real Decreto que modifica el Reglamento del Impuesto sobre la Renta de no Residentes, (IRNR). El objeto de la modificación no es otro que el establecimiento de los medios de acreditación de la residencia que permitan evitar las dificultades con las que se encuentran fondos de pensiones e instituciones de inversión colectiva residentes en otros Estados miembros de la UE para aplicar la exención contenida en el artículo 14 del Real Decreto Legislativo 5/2004, por el que se aprueba el Texto Refundido de la Ley del IRNR.
Las entidades cuyas rentas pretendan ser objeto de exención y que deberán acreditar su residencia en el territorio correspondiente de la UE, son: a) Fondos de pensiones equivalentes a los regulados en el texto refundido de la Ley de Planes y Fondos de Pensiones, b) Instituciones de inversión colectiva reguladas por la Directiva 2009/65/CE y c) Instituciones de inversión colectiva alternativas sometidas a régimen de autorización. El mecanismo implantado difiere en función de que las entidades objeto de exención tengan o no la consideración de entidades en régimen de atribución de rentas (“Flow Through entities”).
Para el primer caso, la exención de las rentas obtenidas se aplicará a sus miembros residentes en otro Estado de la UE. La acreditación de la residencia de sus miembros se realizará conforme a lo dispuesto en la Directiva 2011/16/UE anexos I y II. Para el supuesto de entidades que no tengan la consideración de entidades en régimen de atribución de rentas el procedimiento de acreditación, en el caso de Fondos de Pensiones, mediante declaración formulada por su representante. Para el caso de Instituciones de Inversión Colectiva, mediante certificación emitida por la autoridad competente del Estado miembro en cuestión. La medida debe de ser bien recibida dado que facilitará la aplicación efectiva de la exención en España de este tipo de rentas.
