[value] => Über Fragen des Steuerabzugs bei der grenzüberschreitenden Erbringung von Leistungen und der Überlassung von gesetzlich geschützten bzw. nicht geschützten Rechten haben wir in diesem Newsletter aufgrund der zunehmenden Bedeutung neuer Geschäftsmodelle und deren Beurteilung durch die Finanzverwaltung und der finanzgerichtlichen Rechtsprechung in letzter Zeit bereits öfters berichtet (November 2017: Software und Datenbanken; November 2018: Know-How; April 2019: Online Marketing).
In zwei jüngst veröffentlichten Urteilen vom 24.10.2018 (BFH I R 69/16 und I R 83/16) hat sich der Bundesfinanzhof nun zur steuerlichen Behandlung des vor allem für die Medienwirtschaft bedeutsamen sog. „Total-Buy-Out“ von urheberrechtlich geschützten Werken geäußert. Einkünfte aus der inländischen Verwertung von urheberrechtlichen Schutzrechten ausländischer Rechteinhaber unterliegen nur dann der beschränkten Steuerpflicht und dem Steuerabzug beim inländischen Vergütungsschuldner, wenn sich diese als eine Überlassung der Nutzung oder des Rechts auf Nutzung darstellt. Der Steuerabzug ist hierbei unabhängig von eventuell entgegenstehenden Regelungen in Doppelbesteuerungsabkommen (wie z.B. Art. 12 DBA Spanien – Deutschland, welcher ein ausschließliches Besteuerungsrecht des Ansässigkeitsstaates des Rechteinhabers vorsieht) vorzunehmen, gegen Nachweis der sog. Abkommensberechtigung wird die Abzugssteuer auf Antrag des ausländischen Rechteinhabers jedoch erstattet. Eine vollständige Übertragung und Veräußerung von Rechten unterliegt demgegenüber nicht der inländischen Abzugsbesteuerung, sodass es in den Streitfällen entscheidend auf die der Verwertung zugrundeliegende vertragliche Regelung ankam, die eine Anwendung deutschen Rechts vorsah.
Nachdem Urheberrechte nach § 29 Abs. 1 UrhG grundsätzlich unveräußerlich sind und Ansprüche der Urheber auf eine weitere Erfolgsbeteiligung nach § 32a UrhG bestanden, auf welche vertraglich im Voraus nicht wirksam verzichtet werden kann, blieb es in den Streitfällen im Ergebnis bei einer Abzugssteuerpflicht.

[value] => Dada la importancia de cómo efectuar las retenciones al ofrecerse servicios internacionales y asimismo al ceder derechos protegidos o no protegidos por ley continuamos en este boletín tratando resoluciones relacionadas con nuevos modelos de negocio emitidas recientemente por las autoridades fiscales y los tribunales alemanes (noviembre 2017, software y bases de datos; noviembre 2018, know-how; abril 2019, mercadotecnia digital).
En dos recién emitidas sentencias del Tribunal Federal Supremo de lo Fiscal del 24/10/2018 (BFH I R 69/16 y I R 83/16) se dictaminó sobre el tratamiento fiscal del llamado „total-buy-out“ de obras amparadas por los derechos de autor que sobretodo afectan a la industria mediática. Aquellos ingresos provenientes de la explotación en Alemania de derechos de propiedad pertenecientes a titulares de copyright extranjeros están sujetos a imposición por obligación real y sujetos a retención en caso que se trate de una cesión del uso o del derecho al uso. Dicha retención es independiente del tratamiento según un Convenio para evitar la Doble Imposición (por ej. art. 12 CDI España– Alemania, el cual contempla que el derecho a la imposición pertenece exclusivamente al Estado de residencia del títular del derecho), y en caso de presentarse el debido Certificado de Residencia Fiscal como comprobante del derecho a invocar el CDI será devuelto el importe de dicha retención a solicitud del títular extranjero. Si, a cambio, el traspaso como enajenamiento de los derechos es total, no se está sujeto a la retención fiscal en Alemania, por lo que la ley aplicada por el acuerdo contractual en base del derecho alemán fue decisoria en los casos en cuestión.
Dado que según el art. (§) 29 pár. 1 UrhG (Ley Alemana sobre Derechos de Autor) son los derechos de autor generalmente no transferibles y persisten derechos del títular que implican su participación en los beneficios por el art. (§) 32a UrhG, a lo cual no se puede desistir contractualmente de antemano, queda decir que entonces en caso de pleito la retención fiscal es obligatoria.
