[value] => Der Europäische Gerichtshof (EuGH) hat in seinem Urteil vom 8. Mai 2019 in der Rechtssache C-566/17 entschieden, dass die Mitgliedstaaten verpflichtet sind, eine Methode zur Aufteilung der Vorsteuerbeträge auf “gemischte Aufwendungen”, die sich aus der Ausübung steuerpflichtiger und steuerfreier Tätigkeiten ergeben, einzuführen.
Die umstrittene Frage wurde vom Verwaltungsgericht Breslau im Rahmen eines Rechtsstreits eines polnischen Gemeindeverbands erhoben, der sowohl wirtschaftliche Tätigkeiten, auf die Mehrwertsteuer erhoben wird, als auch nichtwirtschaftliche Tätigkeiten ausgeübt, die als nicht steuerpflichtig gelten und daher keinen Anspruch auf Vorsteuerabzug gewähren. Da das polnische Recht keine klare Methode zur Aufteilung der Vorsteuerbeträge auf “gemischte Aufwendungen” sondern nur den Pro-rata-Satz geregelt hat, beantragte der Gemeindeverband eine Einzelfallauslegung zu den Mehrwertsteuerbestimmungen. Die zuständige polnische Behörde antwortete im Oktober 2016 und erklärte, dass es Sache des Steuerpflichtigen sei, eine geeignete Methode zu wählen, die es ihm ermögliche, die Vorsteuerbeträge auf seine wirtschaftlichen und nichtwirtschaftlichen Tätigkeiten aufzuteilen, unter Bezugnahme auf die Pro-rata-Regelung, woraufhin vom Gemeindeverband Klage eingereicht wurde.
Der EuGH entschied, dass es die Mitgliedstaaten seien, die verpflichtet sind, ein spezifisches Kriterium festzulegen, das einen Vorsteuerabzug ermöglicht unter Beachtung des Neutralitätsprinzips und der in der Mehrwertsteuerrichtlinie festgelegten Grenzen, welche keinen vollständigen Vorsteuerabzug bei dieser Art von Kosten zulässt.
Obwohl der EuGH die Möglichkeit des Vorsteuerabzugs bei “gemischten Aufwendungen” anerkennt, wenn auch nur teilweise, bleibt abzuklären, welche Auslegung die Mitgliedstaaten vornehmen werden, konkret Spanien, dessen Geschäftsordnung, insbesondere die Artikel 95 und 96 des Mehrwertsteuergesetzes, diese Möglichkeit unter Bezugnahme auf den Grundsatz der Ausschließlichkeit ablehnt.

[value] => El Tribunal de Justicia de la UE (TJUE) en sentencia de 8 de mayo de 2019 resuelve el asunto C-566/17 y determina que es obligación de los Estados miembros establecer un sistema de reparto de cuotas del IVA soportado por los “costes mixtos” derivados de la realización de actividades sujetas y no sujetas al Impuesto.
La cuestión perjudicial fue planteada por el Tribunal de lo Contencioso-Administrativo de Breslavia ante una reclamación judicial de una mancomunidad de municipios polacos que realizaba tanto actividades económicas, sobre las que repercutía IVA, como no económicas, que tenían la consideración de no sujetas al Impuesto y que por tanto, no daban derecho a la deducción de las cuotas soportadas por el ejercicio de las mismas. Al carecer la legislación polaca de un método claro de reparto de las cuotas soportadas por “costes mixtas”, dado que el legislador nacional únicamente había regulado la regla de la prorrata, el contribuyente presentó consulta tributaria. La autoridad polaca competente contestó en octubre de 2016 determinando que incumbe al sujeto pasivo elegir un método adecuado que le permita desglosar los importes del IVA soportado entre sus actividades económicas y sus actividades no económicas, remitiéndose a la regla de la prorrata, que fue recurrida por la mancomunidad.
El TJUE resuelve que son los Estados miembros los que tienen la obligación de legislar un criterio especifico para la determinación de la deducción de las cuotas soportadas, siempre respetando el principio de neutralidad y los límites establecidos en la Directiva IVA que no admite la deducción de la totalidad de las cuotas soportadas en este tipo de costes.
A pesar de que el TJUE reconoce la posibilidad de deducir el IVA soportado por los “costes mixtos”, aunque sea parcialmente, quedaría por aclarar qué interpretación van a realizar los Estados miembros, léase España, donde su normativa interna, en concreto los artículos 95 y 96 de Ley del IVA, deniega esta posibilidad y en virtud del principio de afectación exclusiva.
