[value] => Während die Digitalisierung in weiten Teilen des Wirtschaftslebens voranschreitet, arbeitet das deutsche Gerichtswesen noch größtenteils „offline“. Die Einführung des sogenannten „besonderen elektronischen Anwaltspostfach“ (beA), über das Teile der Kommunikation mit den Gerichten elektronisch abgewickelt werden sollen, ist zwar nach anfänglichen Startschwierigkeit online. Auch die Einreichung von Mahnbescheiden und Schutzschriften funktioniert online. „Luft nach oben“ ist aber durchaus vorhanden.
Der Stadtstaat Hamburg will nun eine Vorreiterrolle bei der Digitalisierung von Gerichtsverfahren einnehmen und hat in die Justizministerkonferenz der Bundesländer den Vorschlag eines Pilotprojektes für ein „Online-Gerichtsverfahren“ eingebracht. Dieser sieht vor, dass der Kläger bei einem Streitwert unter EUR 1.000,00 die Klage über eine Online-Maske einreichen kann. Danach allerdings geht es im „realen Leben“ weiter. Möglichst kurzfristig soll das Gericht dann eine mündliche Verhandlung anberaumen. Der Bundesstaat Hamburg kann das Projekt selbstständig planen und durchführen, da die Justiz Sache der Bundesländer ist. Allerdings ist eine Anpassung der deutschen Zivilprozessordnung notwendig, die wiederum auf Bundesebene durch den Bundestag entschieden werden muss. Einen Zeitplan für das Pilotprojekt gibt es noch nicht.
Fraglich ist, ob das Projekt tatsächlich ein Meilenstein auf dem Weg zur Digitalisierung der Justiz ist. Denn bis auf die Einreichung der Klage ändert sich wenig. Zudem stellt sich die Frage, ob die Möglichkeit der Einreichung über das Internet nicht eher zu mehr unüberlegten oder sogar querulatorischen Klageeinreichungen führt. Ein Anwaltszwang herrscht in den Verfahren nicht. Letztlich wird die Erfahrung zeigen, ob das Pilotprojekt eine gute Idee war und andere Bundesländer folgen werden.

A decir verdad, la introducción del denominado “buzón electrónico especial para abogados” (beA), sobre el cual debe realizarse electrónicamente la comunicación con los tribunales, se encuentra operativo online a pesar de las dificultades iniciales. También la presentación de los requerimientos judiciales de pago y escritos cautelares de oposición funcionan online. Pero existe ciertamente margen de mejora.
La ciudad-Estado de Hamburgo quiere ahora desempeñar un papel pionero en la digitalización de los procedimientos legales y ha presentado en el Congreso de Ministros de Justicia de los Estados Federales una propuesta de proyecto piloto de un “procedimiento judicial online”. Este prevé que el demandante pueda presentar una demanda mediante un formulario online en los supuestos en los que la cuantía del litigio sea inferior a 1.000 €. El procedimiento continuaría en la “vida real”. Tan pronto como sea posible, el Tribunal debe fijar una vista oral. La ciudad-Estado de Hamburgo puede planificar y llevar a cabo el proyecto de forma independiente, ya que la justicia es un asunto de los Estados Federales. Sin embargo, es necesaria una adaptación de la Ley de Enjuiciamiento Civil alemana, que, en cambio, debe ser decidida por el Parlamento alemán a nivel federal. Aún no existe un calendario para el proyecto piloto.
Resulta cuestionable si el proyecto constituye realmente un hito en el camino hacia la digitalización de la justicia, pues, a excepción de la presentación de la demanda, existen pocos cambios. Además, plantea la pregunta de si la posibilidad de la presentación a través de internet no dará lugar a una presentación de demandas desmedida o incluso fraudulenta. No se requiere de abogado en el procedimiento. En la práctica se verá si el proyecto piloto es una buena idea y si otros Estados Federales lo siguen.
