[value] => Endlich ist es da! Nach jahrelangen Verhandlungen innerhalb der OCDE ist das multilaterale Abkommen gegen die Verhinderung der Gewinnverkürzung und Gewinnverlagerung, umgangssprachlich, gegen Steuerflucht in internationalen Strukturen und Operationen, unter-schrieben worden. Unter den 68 Staaten, die bis jetzt Teil dieses Vertrages sind, befinden sich auch Deutschland und Spanien.
Mit dieser Regelung wird versucht, gegen aggressive Steuerplanung auf internationaler Ebene vorzugehen, indem Missbrauchsbekämpfungs-maßnahmen implementiert werden, die, sobald der Vertrag in Kraft tritt, -im Moment liegt er dem Kongress zur Ratifizierung vor- automatisch auf alle Doppelbesteuerungsabkommen, die aktuell für Spanien gelten, anwendbar sein wird. Dies gilt natürlich auch für das Doppelbesteuerungsabkommen mit Deutschland aus dem Jahr 2012. Es ist deshalb ratsam, Geschäfte und Investitionen im Ausland einer Überprüfung zu unterziehen, Gesellschaften wie natürliche Personen. Wir weisen außerdem darauf hin, dass diese Revision nicht nur den steuerlich „aggressiven“ Strukturen gelten sollte, sondern auch denen, die im internationalen Umfeld als üblich gelten würden.
Es ist empfehlenswert zu analysieren -um nur einige Fragen anzusprechen-ob Verträge mit Vermittlern und sonstigen Handelsvertretern, sowie die persönlichen und materiellen Mittel über die man im Ausland verfügt, dort Betriebsstätten entstehen lassen, den steuerlichen Wohnsitz, um die Vorteile eines Abkommens in Anspruch zu nehmen, oder ob das Hauptziel eines Geschäfts war, einen steuerlichen Vorteil zu erlangen. In allen diesen Fällen bestünde dann das Risiko, auf die erzielten Gewinne dann im Ausland Steuern zahlen zu müssen.

Tras años de negociaciones en sede de la OECD, se ha concluido la firma del Convenio Multilateral contra la Erosión de Bases Imponibles y el Traslado de Beneficios; hablando en cristiano, la lucha contra la evasión fiscal en las estructuras y operaciones internacionales. Entre los países signatarios del convenio se encuentran España y Alemania, y en total son 68 los países que han suscrito hasta la fecha mencionado convenio.
Con esta norma se pretenden evitar las prácticas de planificación fiscal agresiva en el ámbito internacional, implementando medidas anti-abuso, que a partir del momento de su entrada en vigor –actualmente se tramita su ratificación en el congreso- afectará de manera automática a todos los Convenios de Doble Imposición que mantiene actualmente España, incluyendo claro está, al concluido con Alemania en el año 2012.
Es por ello que resulta aconsejable la revisión de los negocios e inversiones en extranjero; y esto es válido tanto para las sociedades, como para las personas físicas. Advertimos además que dicha revisión no es únicamente necesaria respecto de las estructuras fiscales que podemos tildar de “agresivas”, sino también para aquellas calificadas como usuales en un entorno internacional. Por ejemplo, sería recomendable analizar los acuerdos con comisionistas/ agentes y los medios personales y materiales que se mantienen en otros países, para evitar cualquier establecimiento permanente en el extranjero –y con ello el pago de impuestos sobre beneficios en otro país-, la residencia fiscal para aplicar los beneficios de un convenio, o también si el propósito principal de un negocio ha sido la mera obtención de una ventaja fiscal. Y esto solo por avanzar algunas cuestiones. En definitiva, es momento de echarle un vistazo a las estructuras y negocios en otras jurisdicciones, al objeto de evitar sorpresas indeseables.
