[value] => Das Oberste Gericht in Castilla-León hat sich in einem jüngst ergangenen Urteil zu der Unzulässigkeit einer Videoüberwachung als Beweismittel infolge der mangelnden vorherigen Information des betroffenen Mitarbeiters geäußert. In dem von dem Gericht zu entscheidenden Fall hatte das Unternehmen Anhaltspunkte für die Begehung bestimmter Unregelmässigkeiten seitens eines Arbeitnehmers, weshalb es vorüber-gehend eine versteckte Kamera in dem von dem Arbeitnehmer genutzten Dienstwagen installierte, in dem die Vornahme der betrügerischen Aktivitäten vermutet wurde.
Der Mitarbeiter wurde zu keinem Zeitpunkt auf diese Kameraufzeichnungen hingewiesen. Das Oberste Gericht geht, ohne den Inhalt der Aufzeichnungen zu bewerten, davon aus, dass zwar die Installation der versteckten Kamera im Fahrzeug auf einem begründeten Verdacht seitens des Unternehmens beruhte, ihre Finalität die Aufdeckung der Unregelmässigkeiten seitens des Mitarbeiters war und die Installation zeitlich begrenzt erfolgte, jedoch nicht nachgewiesen wurde, dass das Unternehmen seiner Verpflichtung zur vorherigen Information des Arbeitnehmers nachgekommen ist.
Das Unternehmen trug zwar zu seiner Verteidigung vor, dass dem Arbeitnehmer die Existenz der Kamera bekannt war, das Gericht ist in seinem Urteil jedoch eindeutig und stellt fest, dass weder eine “Vermutung noch eine hypothetische Kenntnis des Arbeitnehmers” von der Existenz einer Kamera angeführt werden können und somit eine Verletzung der Informationspflicht seitens des Unternehmens vorliegt. Es wird daher davon ausgegangen, dass das Beweismittel gegen den Mitarbeiter unter Verletzung seiner Grundrechte erlangt wurde und somit keinerlei Wirkung entfaltet. Dies hat nicht nur zur Folge, dass die im Kündigungsschreiben angeführten Gründe als nicht nachgewiesen angesehen werden, sondern die Kündigung zudem für nichtig erklärt wird.

[value] => El Tribunal Superior de Justicia (TSJ) de Castilla-León se ha pronunciado en una reciente sentencia sobre la ilicitud de una prueba de videovigilancia como consecuencia de la falta de información previa al trabajador afectado. En el caso en cuestión, la empresa tenía indicios sobre ciertas irregularidades de un trabajador, por lo que instaló temporalmente una cámara oculta en el vehículo de empresa usado por éste, en el cual sospechaba que llevaba a cabo sus actividades fraudulentas. Dichas grabaciones de audio y video nunca fueron avisadas al trabajador. El TSJ, sin entrar a valorar el contenido de las grabaciones, entiende que, si bien la instalación de la cámara oculta en el vehículo se basaba en previas sospechas fundadas por parte de la empresa, tenía como finalidad detectar las irregularidades del empleado y era además limitada en el tiempo, no queda acreditada la obligación de la empresa de haber informado previamente al trabajador.
Si bien la empresa se defendió alegando que el trabajador conocía la existencia de estas cámaras, el TSJ es tajante en ese sentido al determinar que no cabe alegar la “deducción o el hipotético conocimiento del trabajador” de la existencia de cámaras y que, por ello, la empresa incumplió la obligación de informar. Por ello, se entiende que la prueba contra el trabajador se obtuvo mediante la violación de sus derechos fundamentales y queda sin efecto. Lo anterior no sólo implica que los hechos alegados por la empresa en la carta de despido no queden acreditados, sino que, además, el despido efectuado ha de ser declarado nulo.
