[value] => Nach mehr als 20 Jahren reformiert die EU die Entsenderichtlinie 96/71/ EG vom Jahre 1996 und beendet damit eine seit 2016 andauernde Debatte u.a. über ungleiche Lohnbedingungen. Dem im März 2016 durch die Sozialkommissarin Thyssen vorgelegte Reformvorschlag haben sowohl Mitgliedsstaaten als auch Europaparlament zugestimmt. Durch die Richtlinie können Arbeitnehmer in andere Mitgliedstaaten temporär entsandt werden. Sie behalten dabei ihren ursprünglichen Arbeitsvertrag, wobei Arbeitgeber Sozialabgaben weiterhin im Herkunfts-land abführten. Zwar mussten die entsandten Arbeitnehmer nach dem Mindestlohn der Gaststaaten bezahlt werden, jedoch führte dies zumeist zu niedrigeren Löhnen, sodass Statistiken zufolge im Durchschnitt osteuropäische Arbeitnehmer bis zu 50 Prozent weniger Lohn erhielten.
Die neue Entsenderichtlinie, die spätestens 2020 von den Mitgliedsstaaten umgesetzt werden muss, verspricht unter anderem dieses Problem in den Griff zu kriegen. Ganz nach dem Leitsatz „gleicher Lohn für die gleiche Arbeit“, sollen gleiche Lohnbedingungen für entsandte und heimische Arbeitnehmer gelten. Nunmehr zwingend anwendbar neben den Mindestlohngesetzen der Mitgliedstaaten sind auch allgemeinverbindliche Tarifverträge, die zumeist Extragehälter wie Weihnachtsgeld, Prämien und Zulagen regeln. Zudem dürfen Reise- sowie Verpflegungskosten nicht mehr vom Lohn abgezogen werden, sondern müssen vom Arbeitgeber getragen werden.
Weitere Erneuerung: Entsendungen sind künftig nur noch bis 12 Monate zulässig, mit einer Verlängerungsmöglichkeit auf insgesamt 18 Monate. Bei Überschreitung gelten für die entsandten Arbeitnehmer uneingeschränkt die Arbeitsbedingungen des Gastlandes. Keine Änderungen gab es im sozialversicherungsrechtlichen Bereich. So dürfen sich entsandte Arbeitnehmer weiterhin in Ihren Heimatländern sozialversichern, wobei die Beiträge hier teils niedriger sind als in westlichen Mitgliedstaaten. Dadurch können Lohnkosten für Arbeitgeber nach wie vor günstiger ausfallen als bei den heimischen Mitarbeitern.

Los estados miembros y el Parlamento Europeo han aprobado la propuesta de reforma presentada por la Comisaria de Asuntos Sociales, la Sra. Thyssen, en marzo de 2016.
La Directiva permite el desplazamiento temporal de trabajadores a otros estados miembros. Los empleados mantienen sus contratos de trabajo original, mientras que los empleadores siguen pagando las cotizaciones a la seguridad social en su país de origen. Aunque a los trabajadores desplazados se les tenía que pagar de acuerdo con el salario mínimo de los países de acogida, la mayoría de los salarios eran más bajos, de modo que, según las estadísticas, los trabajadores de Europa del Este recibían un promedio de hasta un 50 % menos de salario.
La nueva Directiva, que los estados miembros deben aplicar más tardar el año 2020, promete controlar este problema. De acuerdo con el principio rector “igual salario por igual trabajo”, deben aplicarse las mismas condiciones salariales a los trabajadores desplazados y a los nativos. Además, ahora también son obligatorios los convenios colectivos que regulen en su mayoría los salarios extraordinarios, las bonificaciones etc. Además, los gastos de viaje y las dietas ya no pueden deducirse de los salarios, sino que deben ser sufragados por el empleador.
Otra renovación: los desplazamientos sólo se permitirán por un período máx. de 12 meses, con la posibilidad de prorrogarlos hasta un total de 18 meses. Si se superan, los trabajadores desplazados están sujetos plenamente a las condiciones de trabajo del país de acogida.
Sin embargo, no hubo cambios en el ámbito del derecho de la Seguridad Social. Los trabajadores desplazados pueden seguir estando cubiertos por la Seguridad Social en sus países de origen, aunque las cotizaciones son inferiores a las de los estados miembros occidentales. Como resultado, los costes salariales para los empleados desplazados siguen siendo más bajos que para los empleados nativos.
