[value] => Nach spanischem Recht erhält ein unbefristet beschäftigter Arbeitnehmer bei Kündigung seines Arbeitsverhältnisses aus objektiven Gründen eine Abfindung in Höhe von 20 Tagessätzen pro Beschäftigungsjahr, wohingegen ein befristeter Arbeitnehmer eine Abfindung von 12 Tagessätzen erhält und ein Arbeitnehmer mit einem Arbeitsvertrag für eine Übergangszeit keinerlei Abfindung.
In zwei jüngst ergangenen Urteilen („Montero Mateos“ und „Grupo Norte Facility“, beide vom 5. Juni 2018) bestätigt der Europäische Gerichtshof (EuGH) diese unterschiedliche Behandlung von befristeten und unbefristeten Verträgen und die unterschiedlichen Abfindungen, und korrigiert damit sein früheres Urteil vom 14. September 2016, in dem er zunächst festgestellt hatte, dass kein objektiver Rechtfertigungsgrund dafür vorliegt, dass ein befristet beschäftigter Arbeitnehmer nicht dieselbe Abfindung bei Vertragsbeendigung erhält wie ein Arbeitnehmer mit unbefristetem Vertrag. Der EuGH hat nunmehr seine Kriterien geändert und stellt fest, dass keine Diskriminierung vorliegt, da ein objektiver Grund für die unterschiedliche Behandlung der beiden Vertragstypen besteht. Der EuGH gibt der spanischen Regierung Recht, die vorgetragen hatte, dass ein vorübergehend beschäftigter Arbeitnehmer den Verlust seines Arbeitsplatzes von Beginn an erwartet und dieser somit nicht überraschend ist. Im Gegensatz hierzu hat ein unbefristet beschäftigter Arbeitnehmer eine berechtigte Erwartung der Fortsetzung seines Arbeitsverhältnisses, weshalb die Zahlung der Abfindung mit dem Ziel erfolgt, das Frustrieren dieser Erwartung infolge der Vertragsbeendigung aus sachlichem Grund zu kompensieren.
Der EuGH ändert somit die zuvor von ihm vertretene Rechtsauffassung und kommt zu der Schlussfolgerung, dass der Grundsatz der Nichtdiskriminierung den spanischen Vorschriften, die keine Entschädigung für befristet beschäftigte Arbeitnehmer mit einem Arbeitsvertrag für eine Übergangszeit vorsehen, nicht entgegensteht.

[value] => Según la legislación española, un trabajador indefinido percibe una indemnización de 20 días por año de servicio en caso de despido por causas objetivas, mientras que un trabajador temporal cobra una indemnización de 12 días y un trabajador interino ninguna indemnización.
En dos sentencias recientes (“Montero Mateos” y “Grupo Norte Facility”, ambas de 5 de junio de 2018), el Tribunal de Justicia de la Unión Europea (TJUE) avala dicha distinción entre contratos temporales e indefinidos y sus diferentes indemnizaciones , rectificando así su sentencia anterior de 14 de septiembre de 2016 (“De Diego Porras”), en la que inicialmente había determinado que no había causa objetiva que justificase que un trabajador interino no percibiese la misma indemnización por terminación de su contrato que un trabajador con contrato indefinido.
Ahora, el TJUE cambia su criterio y determina que no existe discriminación, ya que encuentra una causa objetiva en la diferente justificación de los dos tipos de contratos. El TJUE da la razón al Gobierno español, que alegó que el trabajador temporal “podía prever en el momento de celebrar el contrato de trabajo” que su empleo tenía una duración determinada, por lo que la terminación del contrato no supone una sorpresa. Al contrario, el trabajador indefinido tiene una expectativa legitima en lo que respecta a la continuidad de su relación laboral, por lo que el abono de la indemnización sirve para compensar la frustración de dicha perspectiva debido a la terminación del contrato por la causa objetiva.
Por ello, el TJUE se retracta de su anterior doctrina y llega a la conclusión de que el principio de no discriminación no se opone a la normativa española que no prevé ninguna indemnización para los trabajadores interinos que cubren un puesto de trabajo.
