[value] => In den meisten deutschen Arbeitsverträgen werden Ausschlussfristen vereinbart, nach denen Ansprüche aus dem Arbeitsverhältnis von den Parteien innerhalb einer bestimmten Frist und schriftlich geltend gemacht werden müssen. Bei Fristablauf verfallen die Ansprüche.
Der BAG-Entscheidung vom 7. Juni 2018 lag folgender Sachverhalt zugrunde: Der Arbeitnehmer, der als Verkäufer eines Autohauses angestellt war, hatte abredewidrig einem Kunden ein noch nicht bezahltes Fahrzeug ausgehändigt. Der Kunde verschwand mitsamt dem Kfz. Obwohl der Wagen nach erheblichem Aufwand lokalisiert und zurückgeführt werden konnte, war dem Arbeitgeber durch das fahrlässige Verhalten des Arbeitnehmers ein Schaden entstanden. Im Arbeitsvertrag hatten die Parteien eine Ausschlussklausel vereinbart: Sämtliche Ansprüche sollten innerhalb von drei Monaten verfallen, wenn sie nicht vorher gegenüber der anderen Partei schriftlich geltend gemacht worden waren. Da der Arbeitgeber erst nach dem Verstreichenlassen der Ausschlussfrist gegen seinen Arbeitnehmer vorging, wies das BAG seine Klage nun letztinstanzlich ab.
In einer weiteren Entscheidung vom 20. Juni 2018 ging es um die Wirksamkeit und die Anforderungen an Ausschlussfristenklauseln. Grundsätzlich unterliegen die Klauseln der AGB-Kontrolle. Sie dürfen nicht weniger als drei Monate betragen und gelten für beide Seiten. Seit der Neuerung vom Herbst 2016 reicht für die Geltendmachung der Verfristung die Textform.
Ergo bleibt festzuhalten, dass die in der arbeitsrechtlichen Praxis vielfach vereinbarten Ausschlussfristen der AGB-Kontrolle obliegen und sie einerseits den Arbeitgeber gegen die Geltendmachung langdauernder Ansprüche des Arbeitnehmers absichern und andererseits den Arbeitnehmer vor Rückgriffen ad infinitum durch den Arbeitgeber schützen.

[value] => La mayoría de los contratos laborales en Alemania estipulan una cláusula de prescripción, según la cual las acciones derivadas del contrato laboral caducan cuando las partes no reclaman a la otra parte dentro del plazo previsto.
La decisión del Tribunal Federal de Trabajo (BAG) del 7 de junio de 2018 se basó en el siguiente caso: Un trabajador de un concesionario de coches había entregado a un cliente un vehículo que éste todavía no había pagado completamente – el trabajador tenía instrucciones de no entregar coches antes de recibir el precio de compraventa. El cliente desapareció junto con el coche, y la empresa soportó unos gastos considerables – causados por la negligencia del trabajador - para recuperar el coche. En el contrato de trabajo, las partes habían acordado una cláusula de prescripción de acciones derivadas del contrato con un plazo de tres meses. Como la empresa no tomó medidas contra su empleado hasta después de la expiración del plazo de caducidad, el Tribunal Federal de Trabajo rechazó su demanda en última instancia.
En otra sentencia con fecha del 20 de junio de 2018, el BAG se centró en la efectividad y los requisitos de las cláusulas de prescripción. En general las clausulas están sujetas al control que prevé la ley sobre condiciones generales (AGB en Alemania). Prevé un plazo mínimo de tres meses aplicables a ambas partes. Desde otoño de 2016 se considera suficiente avisar por escrito la prescripción de la acción. El Tribunal Federal de Trabajo sentenció en un caso que el plazo de prescripción según §203 BGB (código civil alemán) queda suspendido cuando las partes se encontrasen en negociaciones previos a juicio.
Ergo, las clausulas sobre los plazos de prescripción están sujetas al control de la Ley sobre condiciones generales y deben por un lado proteger a la empresa ante demandas futuras de trabajadores y, por otro, proteger igualmente a los trabajadores evitando su exposición prolongada ante acciones de las empresas.
