[value] => Im letzten November kam in Spanien die erste Person ins Gefängnis, die wegen Äußerungen in sozialen Netzwerken verurteilt wurde. Seitdem haben sich die Verurteilungen von Künstlern und Twitter-Nutzern wegen Terrorismusverherrlichung oder Straftaten gegen religiöse Gefühle vervielfacht. Unlängst wurde bestätigt, dass der unter dem Namen ‚Valtònyc‘ bekannte Rapper für das Verfassen von Reimen gegen den König und die Lobpreisung terroristischer Vereinigungen ins Gefängnis gehen wird, nachdem er wegen Verherrlichung der ETA, wegen schwerer Verunglim-pfung des Königs und außerdem wegen Bedrohung des Präsidenten des Circulo Balear verurteilt wurde.
All diese Verurteilungen basieren auf Artikel 578 des Código Penal, welcher im Jahr 2000 eingefügt und im Jahr 2015 eine Reform durchlief, die mit der erhöhten Gefährdung durch Verbreitung über die sozialen Netzwerke gerechtfertigt wurde. Mit der Reform erhöhte sich der maximale Strafrahmen auf eine dreijährige Freiheitsstrafe, was auch die Möglichkeit beinhaltet, ohne vorliegende Vorstrafen ins Gefängnis zu kommen. Außerdem wurde erstmals Bezug auf die sozialen Netzwerke genommen indem eingefügt wurde, dass auf eine erhöhte Strafe zu erkennen ist, „wenn die Taten mittels der Verbreitung über Kommunikationsmedien, das Internet, öffentlich zugänglicher Dienste oder Inhalte oder durch elektronische Kommunikationsdienstmedien oder mittels Nutzung einer Informationstechnologie begangen wurden.“
Dieser Artikel 578 wird stark von Künstlern kritisiert, die seine Abschaffung fordern, weil nach ihrer Auffassung eine offene Kollision mit der Meinungsfreiheit vorliegt. Allerdings stimmt die Mehrheit der politischen Parteien, Staatsanwälte und Richter darin überein, den Artikel nicht abzuschaffen; obgleich vielleicht eine Modifizierung erfolgen kann, da die Regelung übertrieben generisch ist und „zu viel“ mit einbezieht. Nichtsdestotrotz sieht es für den Moment nicht danach aus, dass eine Konkretisierung umgesetzt wird.

[value] => El pasado mes de noviembre entró en la cárcel en España la primera persona condenada por expresiones publicadas en redes sociales. Desde entonces se han multiplicado las condenas a artistas y tuiteros por delitos de enaltecimiento del terrorismo o contra los sentimientos religiosos. Recientemente, el rapero conocido como ‘Valtònyc’, irá a la cárcel por componer rimas contra el Rey y alabar a organizaciones terroristas en sus letras pues ha sido condenado por enaltecimiento de ETA, por un delito de injurias graves al Rey y también por un delito de amenazas contra el presidente del Circulo Balear.
El origen de estas condenas se encuentra en el Artículo 578 del Código Penal que fue introducido en el año 2000 y que experimentó una reforma en el año 2015 justificada en el aumento del riesgo por la difusión a través de redes sociales. Con esta reforma se aumentaba la condena máxima a tres años de prisión, lo cual, suponía la posibilidad de entrar en prisión, aunque no se tuvieran antecedentes penales. Además, se hace referencia por primera vez a las redes sociales pues se añade que la condena se impondrá al alza “cuando los hechos se hubieran llevado a cabo mediante la difusión al público a través de medios de comunicación, internet, o por medio de servicios de comunicaciones electrónicas o mediante el uso de tecnologías de la información”.
Este Artículo 578 ha sido fuertemente criticado por artistas quienes piden su derogación pues entienden que choca abiertamente con la libertad de expresión. Sin embargo, lo cierto es que entre la mayoría de los partidos políticos, fiscales y jueces existe unanimidad en no derogar este artículo, si bien, quizás sí, en su modificación pues es verdad que resulta excesivamente genérico al englobar “demasiado”. No obstante, por el momento, no parece que la citada concreción se vaya a materializar.
