[value] => Der Missbrauch der digitalen Identität einer anderen Person ist die unbefugte Verwendung ihrer Zugangsdaten, aber auch jeder anderen Art von digitalen Informationen, die die Identifikation einer natürlichen Person zulassen.
Dies kann eine Straftat darstellen.
In Spanien existiert kein Gesetz hinsichtlich des Missbrauchs der digitalen Identität, weshalb für den Schutz seiner Opfer auf das spanische Strafgesetzbuch zurückgegriffen werden muss. Noch genießen die Bürger jedoch nicht den notwendigen rechtlichen Schutz, um sich in der digitalen Welt zu schützen.
Artikel 18-4º der spanischen Verfassung besagt, daß die Verwendung der Informationstechnologie nicht zum Nachteil der Ehre oder der individuellen oder familiären Privatsphäre geschehen darf. Der Identitätsmissbrauch findet in Artikel 401 des Strafgesetzbuchs Erwähnung.
Der Missbrauch der digitalen Identität wird nicht als Dauerdelikt angesehen, da die unbefugte Verwendung einer Internetseite oder eines Profils in den sozialen Medien einen punktuellen Missbrauch darstellt.
Die Artikel 197-2 und 197-3 des Strafgesetzbuchs untersagen die Verwendung vertraulicher Daten persönlichen oder familiären Charakters ebenso wie jedweden unbefugten Zugriff – auf welche Weise auch immer – auf diese Daten. Diese Artikel könnten prinzipiell den Missbrauch der digitalen Identität sanktionieren; das Problem ist aber, dass sie lediglich persönliche Daten erwähnen und andere Arten von Informationen, die das Identifizieren einer Person ermöglichen, nicht erfassen.
Sollte ein Delikt vorliegen, so stellt die missbräuchliche Verwendung der Daten nur eine leichte Straftat dar, und es wird schwierig sein, dieses zu beweisen und zu sanktionieren.

[value] => Suplantar la identidad de otra persona implica un uso indebido de cualquiera de sus datos de identificación. Pero también la suplantación de otros datos, como todo tipo de información numérica que permita la identificación de una persona física, que puede ser un delito.
En España no existe ninguna ley sobre la suplantación de la identidad digital, por lo que debemos recurrir al Código Penal para proteger a las víctimas de estos abusos. Los ciudadanos no disponen aún de la seguridad jurídica necesaria para protegerse en el mundo digital.
El artículo 18-4º de la Constitución española dice que el uso de la informática no puede hacerse en detrimento del honor y la intimidad personal y familiar de los ciudadanos. La suplantación de identidad se evoca en al artículo 401 del Código Penal.
La suplantación de identidad digital no se considera un delito de carácter permanente puesto que el uso fraudulento de un sitio web o un perfil en redes sociales sólo persigue un mal uso puntual.
Los artículos 197-2 y 197-3 del Código Penal prohíben la utilización y modificación de los datos reservados de carácter personal o familiar, así como el acceso no autorizado por cualquier medio a estos datos. Estos artículos podrían en un principio sancionar la suplantación de identidad digital; el problema es que sólo hacen referencia a los datos personales y no mencionan otros tipos de datos que permiten identificar y suplantar a una persona.
Si sólo se hubiera producido un delito, la suplantación tendrá la consideración de delito leve y será complicado probar y sancionarlo.
