[value] => Gemäß der Übergangsbestimmung des Mietgesetzes von 1994 („Ley de Arrendamientos Urbanos“), erlöschen die Mietverträge, die vor dem 9. Mai 1985 geschlossen wurden und zum Zeitpunkt des Inkrafttretens des oben genannten Mietgesetzes wirksam waren, wenn nicht innerhalb einer Frist von drei Monaten nach dem Tod des Mieters der Vermieter eine schriftliche Mitteilung vom Versterben erhält, mitsamt Sterbeurkunde und Mitteilung über die Identität des Rechtsnachfolgers, sowie dessen Verwandtschaft mit dem Verstorbenen und gegebenenfalls weiterer Nachweises darüber, dass er die rechtlichen Voraussetzungen der Rechtsnachfolge erfüllt. Bisher war der Oberste Spanische Gerichtshof der Ansicht, dass die gewissenhafte Erfüllung der oben genannten Voraussetzungen notwendig war, damit der Rechtsübergang stattfinden kann. Das am 20. Juni 2018 erlassene Urteil des Gerichtshofes, hält diese Doktrin jedoch für zu starr und ist der Auffassung, dass sie nicht derart unflexibel beibehalten werden kann, ohne die Erfordernisse von Treu und Glauben im Einzelfall zu berücksichtigen.
Daher - so das Plenum der Kammer - kann das Erlöschen des Vertrages ein unbilliges Ergebnis sein, wenn der Vermieter trotz fehlender formaler schriftlicher Mitteilung anderweitig tatsächliche Kenntnis vom Versterben des Mieters und vom Willen des Rechtsnachfolgers, in die Rechtsnachfolge einzutreten, erlangt hat. Das Plenum weist dabei darauf hin, dass das Einverständnis des Vermieters keine Voraussetzung für die Rechtsnachfolge sei. Im Rahmen der neuen Doktrin ist der Gerichtshof der Auffassung, dass im Falle der fehlenden schriftlichen Mitteilung die Kenntnis des Versterbens auf anderen Wegen ebenso wirksam ist, wenn, wie im beurteilten Fall, nachgewiesen ist, dass der Vermieter volle Kenntnis von den Umständen des Todes der Mieterin hatte, da er mit dem Witwer den neuen Mietpreis verhandelt hatte.

[value] => De acuerdo con lo previsto en la disposición transitoria de la Ley de Arrendamientos Urbanos de 1994, los contratos de arrendamiento de vivienda que se celebraron con anterioridad al 9 de mayo de 1985 y que estuvieran subsistentes al tiempo de entrar en vigor dicha Ley, se extinguen si en el plazo de tres meses desde la muerte del arrendatario, el arrendador no recibe notificación por escrito del hecho del fallecimiento, con certificado registral de defunción, y de la identidad del subrogado, indicando su parentesco con el fallecido y ofreciendo, en su caso, un principio de prueba de que cumple los requisitos legales para subrogarse. Hasta la fecha, el Tribunal Supremo había venido entendiendo que, para que tuviera lugar la subrogación, era imprescindible el escrupuloso cumplimiento de los requisitos arriba citados, que incluyen la comunicación, por escrito, del fallecimiento y de la identidad de la persona que tiene la voluntad de subrogarse.
La Sentencia dictada por el Alto Tribunal Supremo el pasado 20 de junio de 2018, sin embargo, ha considerado que dicha doctrina resulta excesivamente rígida y que no puede ser mantenida de manera inflexible sin atender en cada caso a las exigencias que impone la buena fe. Por tal razón -explica el Pleno de la Sala– el efecto extintivo del contrato de arrendamiento puede ser un resultado injusto, cuando, a pesar de no haberse llevado a cabo una notificación formal por escrito, el arrendador tiene conocimiento efectivo del fallecimiento del arrendatario y de la voluntad de subrogación de quien tiene derecho a ello, y advierte que el consentimiento del arrendador no es un requisito para que se produzca la subrogación. Al amparo de la nueva doctrina, el Tribunal estima que, en defecto de comunicación por escrito, resulta igualmente válido el conocimiento del fallecimiento por otros medios, cuándo, como en el caso enjuiciado, queda acreditado que la arrendadora tenía pleno conocimiento de las circunstancias del fallecimiento de la arrendataria, al haber estado negociando con el viudo de ésta el importe de la nueva renta.
