[value] => Das Sponsoring ist nach dem Verkauf der TV-Rechte für den Fußballweltverband (FIFA) die zweitwichtigste Einnahmequelle.
Während sich die Fans erneut auf den Wettkampf der Fußball-WM 2018 in Russland freuen und ihn feiern, sichert dem Ausrichter im Hintergrund ein rechtliches Konstrukt Milliarden von Euros.
Veranstalter der Fußball-WM ist die FIFA. Für diese lässt sich mit dem sportlichen Großereignis eine Menge Geld verdienen. Der Budgetplan des Verbandes sieht im vierjährigen WM-Zyklus 2015 bis 2018 Einnahmen von insgesamt rund 1,23 Milliarden Euro über das Sponsoring vor. Den Markenschutz hat die FIFA besonders bezüglich verbotener Marketingaktionen im Visier, weil sie das kommerzielle Programm der FIFA unmittelbar gefährden, indem die Gefahr der Abwertung des offiziellen Sponsorings besteht. Seit 1982 verkauft die FIFA als Inhaberin sämtlicher Schutzrechte exklusiv Marketingrechte an Unternehmen, die sich „offizielle Sponsoren der Fußball-Weltmeisterschaft“ nennen und mit dem WM-Logo und der Marke FIFA werben dürfen. Im Gegensatz dazu lassen sich inoffizielle Aktionen als Ausdruck fehlender Wertschätzung für die enorme Arbeit einschätzen. Die FIFA leistet stets Arbeit, um die Fußball-WM noch attraktiver und bekannter zu machen, was ohne die finanzielle Unterstützung durch die FIFA-Sponsoren nicht möglich wäre. Im Falle eines Verstoßes drohen Unterlassungs-, Beseitigung-und Schadensersatzklagen. Dabei können enorme Kosten entstehen. Auch könnten unter Umständen die mit dem unlauteren Verhalten erzielten Gewinne abgeschöpft werden.
Beschwichtigend lässt sich zu diesen Prognosen jedoch anmerken, dass nicht jegliche Bezugnahmen auf die WM in der Werbung verboten sind, sofern nicht durch weitere Hinweise, wie etwa als „Official Partner“ der Eindruck erweckt wird, der Werbende sei ein akkreditierter Sponsor des Turniers.

Mientras que los aficionados están ilusionados y celebrando la copa mundial de fútbol de 2018 en Rusia, el organizador de la copa mundial, la FIFA, se está asegurando miles de millones de euros, suponiéndole así una importante fuente de ingresos. El presupuesto de la asociación prevé para en el ciclo cuatrienal de la copa mundial, los años 2015-2018, unos ingresos de aprox. 1,23 miles de millones de euros a través de los patrocinadores.
La FIFA protege su marca contra la vulneración de sus derechos por campañas de marketing prohibidas, capaces de desvalorar el apoyo de los patrocinadores oficiales. A la FIFA le corresponden todos los derechos de propiedad industrial. Desde el año 1982 vende sus derechos exclusivos de marketing a empresas a las que otorga el derecho de titularse “patrocinador oficial de la copa mundial”, permitiéndoles así hacer publicidad con el logo del campeonato mundial y con la marca FIFA. Campañas no oficiales que vulneran este derecho significan una falta de valoración del inmenso trabajo que realiza la FIFA, que siempre intenta mejorar y promocionar la copa mundial de fútbol, lo que sería imposible sin el apoyo de sus patrocinadores. Infracciones de los derechos pueden tener como consecuencia indemnizaciones por daños causados y acciones de cesación que pueden causar altos costes. Además, es posible que se reclamen los beneficios obtenidos por un infractor por un comportamiento desleal a éste.
Para apaciguar el asunto se puede decir que, obviamente, no todos los anuncios con referencia a la competición están prohibidos, sino sólo los que son aptos de crear una confusión respecto a la calidad de patrocinador oficial de la copa mundial.
