Juni erließ das Landgericht Barcelona eine Entscheidung bez. des Verfalls der spanischen Marke Nr 0390096 „AFTERSUN“, eingetragen im Jahr 1962 für die Klasse 3 (unter anderem: ätherische Öle, Kosmetika, etc.), aus Vulgarisierung des Begriffes. Das Gericht kam zu dem Entschluss, dass „Aftersun“ die übliche Bezeichnung für ein Sonnenpflegeprodukt geworden ist und erklärte ferner auch, dass sich der Markeninhaber L‘OREAL bei der Verteidigung der Marke passiv verhalten hatte, da die Gegenseite in dem Gerichtsstreit beweisen konnte, dass L‘OREAL die Verwendung des Begriffes „After-Sun“ seitens von verschiedenen Wettbewerbern lang toleriert hatte, ohne Klage zu erheben, was letztendich dazu geführt hat, dass das Land-gericht Barcelona den Verfall der Marke erklärt hat.
Dieser Fall, welcher nicht selten in der Markenwelt vorkommt, ist ein gutes Beispiel für die widersprüchlichen Konsequenzen einer erfolgreichen Marke, wenn ein Name so berühmt wird, dass dieser sich nicht mehr von der allgemeinen Bezeichnung des Produkts, auf welches es sich bezieht, unterscheiden kann. In dieser Situation müssen die Inhaber der Marke ein Plus an Schutz durchführen, beispielsweise durch (i) Einlegung rechtlicher Schutzmaßnahmen gegen identische oder ähnliche Zeichen zur Verteidigung der Marke, und (ii) Positionierung des Produkts und der Marke durch Marketing-Kampagnen, so dass der Verbraucher den Titel als „Marke“ wahrnimmt und nicht als Gattungsbegriff, zum Beispiel durch Angabe der Bezeichnung als eingetragene Marke mit Zeichen wie ®, TM, usw.

[value] => El pasado 6 de junio, la Audiencia Provincial de Barcelona dictó una sentencia declarando la caducidad de la marca española nº 0390096 “AFTERSUN”, registrada en 1962 para la clase 3 (entre otros: aceites esenciales, cosmética, etc.) por vulgarización de dicho término en España. El tribunal llega a la conclusión que “aftersun” se ha convertido en la designación usual de un producto de tratamiento corporal para después del sol. También declara que L’OREAL, titular de la marca, ha tenido una conducta pasiva en la defensa de la marca que ha propiciado la vulgarización, por cuanto la otra parte pudo acreditar que L’OREAL había tolerado el uso de “aftersun” durante mucho tiempo por parte de diferentes competidores, sin que interpusiera acciones legales, lo que motiva que la Audiencia Provincial de Barcelona finalmente haya declarado la caducidad.
Este caso, para nada singular en el mundo marcario, es un buen ejemplo del doble filo que puede tener el éxito de una marca, cuando una denominación llega a ser tan popular que ya no se distingue la marca por el uso cotidiano del producto al que se refiere. En esta situación, los titulares deben llevar a cabo un plus de protección que consiste tanto en (i) interponer acciones legales contra cualquier signo idéntico o similar y de tal forma defender su marca, y (ii) posicionar el producto y la marca a través de campañas de Marketing de tal forma que el consumidor perciba la denominación como una “marca” y no un término genérico, por ejemplo, divulgando la condición de marca registrada con leyendas del tipo ®, TM o marca registrada.
