September hat das Landgericht Madrid ein Urteil in einem Verfahren zwischen JEAN CASSEGRAIN, Hersteller der Longchamp Handtaschen, und den Inhabern der Webseiten GROUPON und PRIASUK erlassen, das für den Modebereich sehr wichtig sein kann, da das Gericht unter anderen verkündet hat, dass die Longchamp Taschen ausreichend Originalität genießen, um urheberrechtlichem Rechtsschutz zu unterliegen, aufgrund (i) ihrer Zusammensetzung, (ii) der Kombination von verschiedenen Formen, (iii) dem Kontrast von Materialien und (iv) weil sie vollständig von den übrigen bekannten Modellen unterscheidbar sind.
Damit hebt das Urteil des Berufungsgerichts das vom Handelsgericht in Madrid im Rechtsstreit bezüglich des Verkaufs von ähnlichen Taschen (als Beispiel: siehe das Bild unten - links das Original -) in den Webseiten der Beklagten, auf. Die Entscheidung ist so bedeutend, weil das Landgericht Madrid in den Longchamp Taschen Elemente an Originalität und kreativer Arbeit im Sinne des Urheberrechtsgesetzes erkennt, weshalb der Hersteller berechtigt war, das Inverkehrbringen solcher Produkte zu verhindern, die in diesem Sinne als Plagiat einer künstlerischen Arbeit zu verstehen sind.
In einem so aggressiven Markt wie dem der Mode, in welchem nicht nur Fälschungen, sondern die Nachahmung von Mustern und Modellen zwischen den Wettbewerbern geläufig ist, kann dieses Urteil viele Ansprüche bekräftigen, da der Rechtsschutz des Urheberrechets automatisch zum Zeitpunkt der Erstellung entsteht, ohne vorheriger Registrierung wie z.B. bei Marken oder Designs. Auf diese Weise kann der Hersteller, solange Elemente der Originalität und der kreativen Höhe nachgewiesen werden können, andere Produkte als Kopien seiner Kreationen betrachten und ohne weiteres dessen Kommerzialisierung verhindern.

[value] => El pasado 15 de septiembre, la Audiencia Provincial de Madrid dictó una sentencia en un proceso entre JEAN CASSEGRAIN, fabricante de los bolsos Longchamp, y los titulares de los web GROUPON y SARASWATI, que puede ser muy importante para el mundo de la moda, habida cuenta de que viene a reconocer, entre otros pronunciamientos, que los bolsos Longchamp gozan de la originalidad suficiente para ser susceptibles de protección al amparo de los derechos de autor, debido a (i) su composición, (ii) la combinación de formas, (iii) los contrastes de material y (iv) porque resulta plenamente distinguible del resto de modelos conocidos.
Con esto, la sentencia del tribunal de apelación revoca la del Juzgado Mercantil de Madrid en el asunto que enfrentaba a las partes con motivo de la comercialización, por parte de los sitios web demandados, de bolsos considerados como infractores de los derechos de JEAN CASSEGRAIN (a modo de ejemplo, ver la foto más abajo –a la izquierda el original-). Lo realmente llamativo de la resolución de la Audiencia Provincial de Madrid es que reconoce elementos de originalidad como obra creativa en los bolsos Longchamp, según el sentido de la Ley de Propiedad Intelectual, motivo por el que el fabricante estaba legitimado a impedir la comercialización de dichos productos, que en ese sentido se pueden considerar como plagio de una obra artística.
En una industria tan competitiva y agresiva como la moda, donde no ya las falsificaciones piratas sino las imitaciones de diseños entre competidores está a la orden del día, esta sentencia puede servir de apoyo a muchas reclamaciones, porque la protección que otorga la Ley de Propiedad Intelectual es automática desde el momento de la creación, no haciendo falta solicitar y pagar registro alguno, como en el caso de las marcas o los diseños. De tal forma, siempre y cuando se pueda acreditar elementos de originalidad y altura creativa, el fabricante podrá impedir la comercialización de productos que puedan ser considerados como imitaciones de sus creaciones.
