[value] => Das Bundesministerium der Justiz und für Verbraucherschutz hat einen Gesetzentwurf vorgelegt, der die Eindämmung des Abmahnmissbrauchs durch unseriöse Abmahner vorsieht.
Mit dem „Entwurf eines Gesetzes zur Stärkung des fairen Wettbewerbs” soll den Praktiken von unseriösen Kanzleien und Verbänden ein Ende bereitet werden, die unerhebliche Verstöße gegen das Wettbewerbsrecht zur Generierung von Aufwendungsersatz und Vertragsstrafen ausnutzen.
Diese sind oftmals weniger am Schutz des Wettbewerbsrechts interessiert, sondern sind nur darauf aus sich auf Kosten der Abgemahnten, häufig kleine und mittlere Unternehmen, die sich ihrer Verstöße nicht bewusst waren, zu bereichern. Beispielsweise geschieht dies durch die Geltendmachung unangemessen hoher Vertragsstrafen bei wiederholten, jedoch unerheblichen Verstößen gegen das Wettbewerbsrecht. Dazu kommen dann noch ausufernde Anwaltskosten sowie Entschädigungszahlungen mit denen die abgemahnten Unternehmen konfrontiert werden.
Der Entwurf von Bundesjustizministerin Katarina Barley (SPD) sieht höhere Anforderungen an die Kläger bei der Geltendmachung von Ansprüchen durch Mitbewerber und Wettbewerbsverbände vor, sowie eine Beschränkung des Streitwerts bei unerheblichen Verstößen, um die Anreize finanzieller Art solcher Abmahnungen zu verringern. Außerdem umfasst der Entwurf die Möglichkeit eines Gegenanspruchs des Abgemahnten gegen den Abmahnenden in unberechtigten Fällen.
Darüber hinaus soll auch die Zahl der Mahnberechtigten eingeschränkt werden. Nach dem Gesetzentwurf soll ein Mitbewerber nur noch dann abmahnberechtigt sein, wenn er „in nicht unerheblichem Maße ähnliche Waren oder Dienstleistungen vertreibt oder nachfragt”. Nach bisheriger Rechtslage konnte jeder Gewerbetreibende die Unterlassung einer wettbewerbswidrigen Handlung fordern, der mit dem Abgemahnten als Anbieter oder Nachfrager von Waren oder Dienstleistungen in einem konkreten Wettbewerbsverhältnis steht.

El „proyecto de ley para reforzar la competencia leal“ tiene por objeto poner fin a las prácticas dudosas de despachos de abogados y asociaciones que sacan provecho económico de infracciones menores de las normas en materia de competencia leal para reclamar el pago de indemnizaciones y penalizaciones contractuales.
Están más interesados en enriquecerse a costa de otros que en la protección del derecho de la competencia. A menudo se trata de pequeñas y medianas empresas, que incluso desconocen sus infracciones. Por ejemplo, esto se hace imponiendo sanciones desmesuradamente altas para infracciones repetidas pero insignificantes contra la ley de competencia. Además, las empresas se enfrentan a los honorarios desproporcionados, impuestos por los bufetes, y pagos de indemnizaciones.
El proyecto de la Ministra Federal de Justicia, Katarina Barley (SPD) establece requisitos más estrictos para los demandantes en la presentación de reclamaciones por parte de los competidores y las asociaciones de defensa de la competencia, así como una limitación de la cuantía en litigio en caso de infracciones menores, con el fin de disminuir la “atracción” económica de este tipo de reclamaciones. A todo esto, el proyecto incluye la posibilidad de que la parte demandada reclame contrapretensiones en caso de reclamaciones injustificadas.
Está previsto además de limitar la legitimación para demandar. Según el proyecto de ley, un competidor sólo estará legitimado de reclamar un comportamiento desleal si „vende o solicita bienes o servicios similares en una medida no irrelevante“. De momento, cualquier comerciante que se encuentra en una relación competitiva concreta con la persona amonestada como proveedor o consumidor de bienes o servicios puede exigir una orden judicial contra un acto contrario a la competencia.
