[value] => Sofortige Kommunikationsmethoden sind in den letzten Jahren dank der Entwicklung verschiedener sozialer Netzwerke (WhatsApp, Twitter, Facebook) zunehmend gang und gäbe geworden und haben andere schriftliche bis vor wenigen Jahren vorherrschende Kommunikationsmethoden (herkömmliche Post, E-Mail, Fax) größtenteils ersetzt.
Über Instant Messaging Programme und soziale Netzwerke versandte und erhaltene Nachrichten sind in unserer Gesellschaft inzwischen alltäglich, und sie können deswegen auch von den Gerichten nicht ignoriert werden, da viele dieser Nachrichten wichtige rechtliche Auswirkungen in den verschiedenen Gerichtsbarkeiten haben können. So können beispielsweise Unterhaltungen mit Arbeitskollegen oder Vorgesetzten arbeitsrechtliche Konsequenzen auslösen (Sanktionen oder sogar Kündigungen, Rücktritte, usw.) oder Kommunikationen zwischen Vertragsparteien zivilrechtliche Auswirkungen haben, und es können sich sogar strafrechtliche Konsequenzen einstellen (bei rechtswidrigen Eingriffen in die Privatsphäre, bei Delikten gegen die Ehre, usw.).
Wie aber kann in einem Gerichtsverfahren der korrekte Versand oder Empfang einer solchen Nachricht nachgewiesen werden? Normalerweise ist eine einfache Kopie der Nachricht oder ein “screenshot” nicht ausreichend, und wenn die gegnerische Partei bestreitet, eine Nachricht verschickt oder erhalten zu haben, ist ein Expertengutachten, welches den Ursprung der Kommunikation, die Identität der an der Unterhaltung Beteiligten und die Echtheit der Nachricht selbst feststellt, erforderlich. Das heißt, die Rechtsprechung stellt an dieser Art von Nachrichten dieselben Ansprüche, die sie auch an E-Mail-Kommunikationen stellt.
In gewissen Situationen könnte jedoch auch eine Zeugenaussage ausreichend sein. Wenn zum Beispiel mehrere Personen an einer Unterhaltung beteiligt sind (z.B. WhatsApp-Gruppen), könnten diejenigen, die nicht Verfahrenspartei sind, die Echtheit und den Inhalt einer Unterhaltung bezeugen.
Und so wie sich unsere Kommunikationsmethoden entwickeln werden, wird sich aller Voraussicht nach auch die Rechtsprechung weiterentwickeln.

[value] => En los últimos años se han generalizado formas de comunicación instantánea, gracias al desarrollo de las diferentes redes sociales (WhatsApp, Twitter, Facebook), que en buena medida han reemplazado otros medios de comunicación escrita predominante hasta hace unos años (correo electrónico, tradicional, fax).
Los mensajes enviados y recibidos a través de programas de mensajería instantánea y redes sociales constituyen, por tanto, una realidad cotidiana dentro de nuestra sociedad y, por ello, no pueden ser ignorados en la práctica de nuestros juzgados y tribunales, ya que muchos de estos mensajes pueden tener implicaciones jurídicas importantes en los diferentes órdenes jurisdiccionales. Así, hay conversaciones con compañeros de trabajo o superiores que pueden tener consecuencias en el ámbito laboral (sanciones o incluso despidos, dimisiones, etc.), civil (comunicaciones entre partes contratantes, etc.) o incluso penal (delitos contra la intimidad, contra el honor, etc.).
Ahora bien, ¿cómo se acredita ante un juzgado el correcto envío o recepción de un mensaje de este tipo? En términos generales, no será suficiente aportar una mera copia del mensaje o “pantallazo”, sino que, si la otra parte niega haber sido la autora o haber recibido el mensaje, dichas comunicaciones deberán acompañarse de un dictamen pericial que identifique el origen de la comunicación, la identidad de los participantes en la conversación y la realidad del mensaje mismo. Es decir, se exige por la jurisprudencia los requisitos que venía exigiendo para acreditar las comunicaciones por correo electrónico.
En determinados supuestos, sin embargo, podría ser suficiente la prueba testifical. Así, por ejemplo, si se trata de una conversación abierta a varias personas (piénsese en los populares grupos de WhatsApp), los intervinientes en dicha conversación que no sean parte en el procedimiento podrían ratificar el contenido y la realidad de los mensajes.
