[value] => Am 21. März 2018 wurden wichtige Initiativen der Europäischen Kommission bekannt, mit denen die direkte Besteuerung im Digitalen Binnenmarkt geregelt werden soll.
Es geht um zwei Richtlinienvorschläge und eine Empfehlung. Der erste Richtlinienvorschlag führt ein neues Konzept der „festen digitalen Niederlassung“ ein, der zweite sieht eine neue Steuer für bestimmte digitale Dienstleistungen vor und die Empfehlung zielt auf eine Neuverhandlung der Doppelbesteuerungsabkommen ab.
Die Initiativen sind eingebettet in eine Mitteilung an das Parlament und den Rat mit der Bezeichnung „Time to establish a modern, fair and efficient taxation standard fort the digital economy“. Nicht nur die Europäische Kommission ist mit ihrer Initiative aktiv geworden, auch die OECD hat einen Vorschlag zur Besteuerung der sogenannten digitalen Wirtschaft entwickelt.
Da es allerdings vorhersehbar ist, dass die von der OECD angestoßenen Maßnahmen sich mindestens bis zum Jahr 2020 verzögern werden, wollte die Europäische Kommission den Prozess vorantreiben. Die von der Kommission ins Auge gefassten Lösungen, die dem Europäischen Parlament zur Konsultation vorgelegt werden und für ihre Annahme die Einstimmigkeit der Mitgliedstaaten benötigen, enthalten inhaltlich zwei Schwerpunkte: eine kurzfristige Übergangslösung, die in der Etablierung einer neuen Digitalsteuer in der EU auf die Bruttoeinnahmen (Umsatz) besteht; und eine mittel - bis langfristige endgültige Lösung, mit der, basierend auf dem neuen Konzept der „wesentlichen Digitalpräsenz“, der Begriff der festen Niederlassung neu definiert wird. Diese Steuer würde auf in der EU erzielte Einnahmen für bestimmte Aktivitäten großer Unternehmen, die in der EU tätig sind, weltweite Jahreseinnahmen von über 750 Millionen Euro erzielen und deren in der EU besteuerte digitale Geschäfte 50 Millionen Euro übersteigen, angewendet werden. Die Übergangslösung ist nicht frei von Kontroversen, weswegen es nötig ist, die weitere Entwicklung zu verfolgen.

[value] => El pasado 21 de marzo de 2018 se dieron a conocer importantes iniciativas de la Comisión Europea para regular la fiscalidad directa en el Mercado Único Digital.
Se trata de tres documentos que incluyen dos propuestas de Directivas y una recomendación.
La primera propuesta de Directiva introduce un nuevo concepto de “establecimiento permanente digital”; la segunda propone introducir un nuevo impuesto sobre ciertos servicios digitales y la recomendación lo es para que los estados miembros renegocien sus convenios de doble imposición.
Estas iniciativas se enmarcan en una comunicación al Parlamento y al Consejo denominada “Time to establish a modern, fair and efficient taxation standard for the digital economy”. No sólo la Comisión Europea se ha movido mediante estas iniciativas, sino también la OCDE ha desarrollado una propuesta en torno a la tributación de la denominada economía digital.
No obstante, dado que es previsible que las acciones impulsadas por la OCDE vayan a ralentizarse al menos hasta el 2020, la Comisión Europea ha querido avanzar este proceso. Las soluciones que plantea la Comisión, que serán sometidas a consulta al Parlamento Europeo para su aprobación requiriendo la unanimidad de los Estados miembros, giran en torno a dos ejes: una solución transitoria a corto plazo que consistirá en el establecimiento de un nuevo impuesto digital en la UE, que grave los ingresos brutos (ventas), y una definitiva a medio-largo plazo, consistente en la redefinición del concepto de establecimiento permanente, basado en el nuevo concepto de “presencia digital significativa, (PDS)”. El impuesto se aplicaría sobre ingresos generados en la UE para ciertas actividades realizadas por grandes compañías que operen en la UE, con un volumen global de ingresos anual que supere los 750 millones de euros y cuyas actividades digitales gravadas en la UE superen los 50 millones de euros. Esta medida transitoria no está exenta de polémica por lo que se hace necesario seguir su evolución.
