[value] => Steuerforderungen des deutschen Fiskus aus der Einkommen-, Körperschaft- und Gewerbesteuer (sowie der Umsatzsteuer), sind 15 Monate nach Ablauf des Kalenderjahrs, in dem die Steuer entstanden ist, bis zum Ablauf des Tages, an dem die Steuerfestsetzung wirksam wird, in Höhe von 0,5 % pro Monat, also in Höhe von 6 % pro Jahr, zu verzinsen (Nachzahlungszinsen). Ergibt sich für den oben genannten Zeitraum ein Steuerguthaben zugunsten des Steuerpflichtigen, ist auch dieses zu verzinsen (Erstattungszinsen).
Von großer praktischer Bedeutung ist die Verzinsung insbesondere für nachträgliche Steuerfestsetzungen aufgrund von steuerlichen Betriebsprüfungen, allein in den letzten zwei Jahren betrugen die Einnahmen des deutschen Fiskus hieraus rund 2 Milliarden Euro. Während Nachzahlungszinsen bei der Ermittlung der steuerlichen Bemessungsgrundlage nicht abgezogen werden können, unterliegen Erstattungszinsen vollumfänglich der Besteuerung.
In einem am 14.05.2018 veröffentlichten Beschluss vom 25.04.2018 hat der Bundesfinanzhof (BFH) in einem Verfahren des einstweiligen Rechtsschutzes (BFH IX B 21/18) nun schwerwiegende Zweifel an der Verfassungsmäßigkeit von Nachzahlungszinsen geäußert. Der gesetzlich festgelegte Zinssatz verletzte zumindest ab dem Jahr 2015 den allgemeinen Gleichheitssatz nach Art. 3 Abs. 1 des Grundgesetzes (GG), da dieser realitätsfern bemessen sei, weil sich im Streitzeitraum ein niedriges Marktzinsniveau strukturell und nachhaltig verfestigt habe. Bereits in seinem Urteil vom 01.07.2014 habe der erkennende Senat im Verfahren IX R 31/13 für Verzinsungszeiträume nach dem 31.02.2011 darauf hingewiesen, dass der Gesetzgeber bei dauerhafter Verfestigung des Niedrigzinsniveaus verfassungsrechtlich prüfen müsse, ob die seit dem Jahr 1961 geltende Zinshöhe auch unter veränderten Umständen beibehalten werden könne.
Bis zu einer Entscheidung im Hauptsacheverfahren sollte daher gegen die Festsetzung von Nachzahlungszinsen Rechtsmittel eingelegt und Aussetzung der Vollziehung beantragt werden.

[value] => Las deudas al fisco alemán en concepto de Impuesto sobre la Renta de las Personas Físicas, Impuesto sobre Sociedades e Impuesto sobre Actividades Económicas - así como al IVA - devengan intereses a partir de los 15 meses luego del año del devengo del impuesto y hasta el día en que se notifique la liquidación, a un tipo del 0,5 % mensual, es decir, a 6 % anual (interés de demora). Si para el periodo mencionado resulta un crédito fiscal a favor del obligado tributario, éste también devengará intereses (interés de reembolso).
El devengo de intereses es de gran importancia en la práctica en los supuestos de liquidaciones posteriores con motivo de inspecciones fiscales, ya solamente en los dos últimos años los ingresos del fisco alemán por dicho motivo alcanzaron alrededor de 2 mil millones de euros. Mientras que los intereses de demora no son deducibles en la determinación de la base imponible, los intereses a reembolsar están sujetos a imposición en su totalidad.
En una resolución del 25/04/2018 publicada el 14/05/2018, el Tribunal Federal Supremo de lo Fiscal (BFH) manifestó serias dudas sobre la constitucionalidad de los intereses de demora en un procedimiento de medidas cautelares (BFH IX B 21/18). El tipo de interés legal vulnera, por lo menos a partir del año 2015, el principio general de igualdad en conformidad con el Art. 3 (1) de la Constitución alemana, ya que su cuantificación no se basa en la realidad, pues en el periodo controvertido se consolidó estructuralmente a un nivel inferior del interés de mercado de forma duradera. La Sala ya indicó en su sentencia de fecha 01/07/2014, en el procedimiento IX R 31/13, que para los periodos de interés tras el 31/02/2011 el legislador debía comprobar la constitucionalidad en el caso de consolidación en tiempos de bajo nivel de interés, si el tipo de interés aplicable desde el año 1961 también podía mantenerse en caso de que cambien las circunstancias.
Hasta la decisión en el procedimiento principal debería recurrirse a la liquidación de intereses de demora y solicitarse la suspensión de la ejecución.
