[value] => Nach Artikel 52 Absatz d) des Arbeitnehmerstatuts können Unternehmen ein Arbeitsverhältnis durch Kündigung aus objektiven Gründen beenden, wenn die mit zeitlichen Zwischenräumen eintretenden Fehlzeiten eines Arbeitnehmers, einschließlich berechtigter Fehlzeiten, 20% der Arbeitstage innerhalb eines Zeitraums von zwei aufeinanderfolgenden Monaten (“kurzer Zeitraum”) übersteigen und soweit diese Fehlzeiten 5% der Arbeitstage innerhalb der zwölf vorangehenden Monate (“langer Zeitraum ”) darstellen; oder wenn diese 25% der Arbeitstage in vier unterbrochenen Monaten innerhalb von zwölf Monaten übersteigen.
Der Oberste Gerichtshof, der sich bisher nicht zur Berechnung des “langen Zeitraums” geäußert hatte, hat kürzlich ein Urteil bezüglich der Festlegung des sog. “dies ad quem” erlassen, d.h. des Tages, ab dem die Fristen nach hinten zu berechnen sind. Dabei hat er entschieden, dass die erste der Fristen (kurzer Zeitraum) von zwei bzw. von vier Monaten und die zweite der Fristen (langer Zeitraum) von zwölf Monaten - “in einem einzigen Zeitraum von zwölf Monaten zusammenfallen müssen, auch wenn das Kriterium für ihre Berechnung in Bezug auf die erste Frist entsprechend der zu berücksichtigenden eingetretenen Fehlzeiten unterschiedlich ist”. Zudem wird in dem Urteil betont, dass “die Differenz zwischen beiden Zeiträumen ausschließlich in der Anzahl der Fehlzeiten besteht, die sich danach unterscheidet, ob die Fehlzeiten in aufeinanderfolgenden oder nicht aufeinanderfolgenden Monaten eintreten.”
Der Zeitraum zur Berechnung der gerechtfertigten Fehlzeiten ist daher von dem Tag an rückwärts zu bestimmen, an dem die Kündigung des Arbeitsverhältnisses erfolgt, wobei der Oberste Gerichtshof feststellt, dass sowohl der Zeitraum von zwei bzw. vier Monaten mit dem Zeitraum von zwölf Monaten zusammenfallen müssen, da der Unterschied zwischen beiden nur in der Anzahl der Fehlzeiten liegt, je nachdem, ob es sich um aufeinanderfolgende Monate handelt oder nicht, nicht jedoch von der Gesamtanzahl der zu berücksichtigenden Monate, die in beiden Fällen zwölf Monate ist.

[value] => Según lo establecido en el artículo 52 apartado d) del Estatuto de los Trabajadores, las empresas pueden proceder a la extinción de un contrato laboral mediante despido por causas objetivas cuando las ausencias intermitentes de un trabajador, incluyendo las ausencias justificadas, superen el 20% de la jornada hábil en un periodo de dos meses consecutivos (“periodo corto”) y siempre y cuando estas ausencias impliquen o alcancen un 5% de la jornada hábil en los doce meses anteriores (“periodo largo”); o cuando éstas superen el 25% de la jornada hábil en cuatro meses discontinuos dentro de un periodo de referencia de doce meses.
El Tribunal Supremo (TS), que hasta ahora no se había pronunciado sobre la manera o la forma de computar el llamado “periodo largo”, acaba de dictar una sentencia en unificación de doctrina en torno a la fijación del llamado “dies ad quem”, es decir, el día a partir del cual deben computarse los plazos hacia detrás.
En ese sentido, el TS ha determinado en su reciente sentencia que el primero de los plazos (periodo corto) de dos o de cuatro meses según cada caso, y el segundo de los plazos (periodo largo) de doce meses -que es el plazo discutido en citada sentencia- “han de coincidir en un único periodo de doce meses, aunque el criterio para su cómputo sea distinto respecto al primero en función de las bajas computables que hubieren tenido lugar”. Asimismo pone de manifiesto que “la diferencia entre ambos periodos radica exclusivamente en el volumen de ausencias, que podrá variar según se produzcan en meses consecutivos o discontinuos.”
Por ello, el período para calcular las ausencias justificadas ha de computarse desde el día en que se produce el despido, hacia atrás, considerando el TS que tanto el periodo de 2 ó 4 meses en su caso coinciden en el periodo de 12 meses, pues la diferencia entre ambos radica exclusivamente en el volumen de ausencias, que varía según sean en meses consecutivos o discontinuos, pero no respecto de los meses totales de ausencias computables, que es de 12 meses.
