[value] => Dem Urteil des Bundesverwaltungsgerichts lag folgender Sachverhalt zugrunde: Das Universitätsklinikum Köln führte, für die bei ihm beschäftigten Ärzte, sogenannte Arbeitszeitschutzkonten. Diese dienten der Einhaltung der höchstzulässigen Arbeitszeit im Jahresdurchschnitt. Die wöchentliche Höchstarbeitszeit wurde als Soll verbucht und die tatsächlich geleistete Arbeitszeit als Haben erfasst. Tage des gesetzlichen Mindesturlaubs wurden so verbucht, als sei an ihnen regulär gearbeitet worden. Die darüberhinausgehenden Urlaubstage und gesetzlichen Feiertage, die auf einen Werktag fielen, wurden vom Universitätsklinikum jedoch als normale Arbeitstage gewertet, an denen die Arbeitnehmer nicht arbeiteten, sodass an diesen Tagen eine Arbeitszeit von null Stunden zusammenkam. Damit konnten diese Tage zum Ausgleich für überdurchschnittlich geleistete Arbeit an anderen Tagen herangezogen werden.
Die zuständige Arbeitsschutzbehörde untersagte die Praxis des Klinikums, da die Regelung gegen das Arbeitszeitgesetz verstoße.
Die hiergegen erhobene Klage des Universitätsklinikums blieb in beiden Vorinstanzen erfolglos. Bei der Frage, ob über den gesetzlichen Mindest-urlaub hinaus gewährte Urlaubstage bei der Höchstarbeitszeitberechnung als Ausgleichstage berücksichtigt werden dürfen, schloss sich das Bundesverwaltungsgericht den Vorinstanzen an. Das Gericht vertrat insbesondere den Standpunkt, dass als Ausgleichstage nur Tage dienen können, an denen der Arbeitnehmer nicht schon wegen Urlaubsgewährung von der Arbeitspflicht freigestellt ist. Gesetzliche Feiertage, die auf einen Werktag fallen, dürfen bei der Berechnung der durchschnittlichen Höchstarbeitszeit nicht als Ausgleichstage herangezogen werden. Gesetzliche Feiertage seien keine Werktage und grundsätzlich beschäftigungsfrei. Daher seien sie bei der Berechnung der werktäglichen Höchstarbeitszeit nach dem Arbeitszeitgesetz nicht in den Ausgleich einzubeziehen.

[value] => La sentencia se basaba en la siguiente situación: El hospital universitario de Colonia lleva un registro de comienzo y fin de jornadas de los médicos contratados. El registro sirve para controlar el cumplimiento del cómputo máximo de horas anuales. Por un lado se contabiliza el máximo legal de las horas semanales como debido y por otro lado se contabiliza el tiempo trabajado como cumplido. Cada día de vacaciones mínimas (días de vacaciones al año según convenio) se contabiliza como día cumplido. Los días de vacaciones (extratarifarias) y los días de los festivos contabilizan como días normales de trabajo en los que se registra cada jornada con cero horas cumplidas. Esos días se tienen en cuenta para compensar con las horas extraordinarias de otras jornadas.
La autoridad laboral competente prohibió tal práctica del hospital por infringir la ley de Jornada Laboral (Arbeitszeitgesetz).
La demanda del hospital universitario quedó sin éxito en dos instancias previas. Ante la pregunta, si las vacaciones extratarifarias y los días festivos podrían ser tenidos en cuenta para compensar con las horas extraordinarias, el Tribunal Administrativo Federal alemán confirmó las sentencias previas. El Tribunal declaró de forma expresa que como días de compensación sólo pueden tenerse en cuenta los días en los que el empleado no ha sido eximido de su trabajo por vacaciones. Los días festivos nunca pueden considerarse para compensar y calcular un promedio anual de jornadas de trabajo, son días de libre disposición para el trabajador y por ello no deben considerarse días hábiles. Por lo tanto, no se pueden tomar para el cálculo de compensación de horas, aplicado por el empresario.
