[value] => Vor Kurzem haben wir erlebt, wie eine Gerichtsentscheidung von der Öffentlichkeit deutlich kritisiert wurde. Wir verweisen auf das umstrittene Urteil des Landgerichts Pamplona zu einem kontrovers diskutierten Missbrauchsfall.
Bezugnehmend auf diese Entscheidung haben auch Richter und Staatsanwälte dieser gerichtlichen Entscheidungen, sowie der Rechtsmittelmöglichkeiten hohe Beachtung geschenkt. Unabhängig der obigen Ausführungen haben sie anerkannt, dass die Schulungen, die sie zu Genderfragen erhalten haben, unzureichend waren. Schließlich hat sich die Regierung über den Justizminister dazu bereit erklärt, eine Studie über die mögliche Reform des Strafgesetzbuches durchzuführen.
Dabei ist zu bedenken, dass das spanische Strafgesetzbuch 23 Jahre alt ist und seitdem 30 Reformen durchlaufen hat. Die letzte war erst vor drei Jahren und es wurden eine Vielzahl von Modifikationen vorgenommen. Allerdings hat sich, trotz der mehrfachen bisherigen Reformen des Strafgesetzbuches, keine von ihnen mit Straftaten gegen die sexuelle Selbstbestimmung beschäftigt, weshalb diese Normen noch in derselben Form bestehen, wie bei Verabschiedung des Strafgesetzbuches im Jahr 1995.
Kurzum, dieser Fall ist beispielhaft dafür, dass es der öffentlichen Meinung gelungen ist, die Behörden zu einer Gesetzesänderung zu bewegen, die sich der heutigen Zeit anpasst. Diese Reform muss auf jeden Fall in den Grundrechten beachtet und in der spanischen Verfassung verankert werden. Allerdings werden wir noch einige Zeit warten müssen, bis der Inhalt der so dringend notwendigen Gesetzesänderung bekannt wird.

[value] => Recientemente hemos sido testigos de cómo la opinión pública ha criticado abiertamente una decisión judicial. Nos referimos a la controvertida sentencia de la Audiencia Provincial de Pamplona sobre un polémico asunto de abuso.
Sobre esta sentencia se han manifestado también los jueces y fiscales, quienes han expuesto su respeto por las decisiones judiciales y por el sistema de recursos frente a estas decisiones. Sin perjuicio de lo anterior, también han reconocido que la formación que han recibido sobre temas de género resulta insuficiente. Por último, el gobierno, a través del Ministro de Justicia, manifestó su voluntad de proceder a realizar un estudio sobre la posible reforma del Código Penal.
Recordemos que el Código Penal español tiene 23 años y desde entonces ha experimentado 30 reformas. La última hace tan solo tres años, por la que se introdujeron una multitud de modificaciones. Sin embargo, y pese a las múltiples reformas experimentadas en el Código Penal hasta la fecha ninguna de ellas había afectado a los delitos contra la libertad sexual, con lo que su regulación era la misma desde que se aprobó el Código Penal en el año 1995.
En definitiva, en esta ocasión se observa cómo ha sido la opinión publica la que ha conseguido movilizar a los poderes públicos para conseguir un cambio legislativo que se adapte a los tiempos presentes; reforma que deberá en todo caso respetar los derechos fundamentales recogidos en la Constitución Española. Tendremos todavía que esperar un tiempo para conocer el contenido de esta nueva modificación tan demandada.
