[value] => Am vergangenen 9. März 2018 wurde im Amtsblatt des spanischen Parlaments der Vorschlag zum Gesetz veröffentlicht, durch den die konsolidierte Fassung des Gesetzes über die örtlichen Finanzämter geändert werden soll, nachdem das spanische Verfassungsgericht am 11. Mai 2017 mehrere Artikel des Gesetzes im Zusammenhang mit der Steuer auf den Wertzuwachs bei städtebaulichem Boden (im Spanischen allgemein bekannt als „plusvalía municipal“, übersetzt als „gemeindliche Wertzuwachssteuer“) für verfassungswidrig und nichtig erklärt hat, und zwar insoweit als auch Situationen besteuert wurden in denen kein Wertzuwachs bestand.
Die Wertzuwachssteuer hat zum Zweck den Wertzuwachs städtebaulichen Bodens im Zeitraum zwischen dessen Erwerb und dessen Veräußerung zu besteuern. Jedoch wurden auf Grund der objektiven Bewertungsmethode (unter Heranziehung des Katasterbodenwertes) auch Fälle besteuert, in denen ein Verlust des Wertes vorlag. Als Folge des genannten Urteils führt der Vorschlag einen neuen Tatbestand der Befreiung für die Fälle ein, in welchen der Steuerpflichtige belegen kann, dass er keinen Wertzuwachs erhalten hat. Der Nachweis wird durch die Differenz des Wertes beim Erwerb und der Veräußerung geführt. Dabei kommt es auf die Beträge an, die jeweils beim Erwerb und der Veräußerung beglichen wurden, das heißt, die in den Urkunden („escrituras“) angeführten Werte oder diejenigen, die von der Finanzverwaltung festgestellt wurden, wenn letztgenannte höher sind.
Des Weiteren ist auch die Änderung der Ermittlung der Bemessungsgrundlage vorgesehen, die sich in Zukunft nach Höchstkoeffizienten in Abhängigkeit von den Jahren der Eigentümerschaft richten wird. Diese werden jährlich durch Normen mit Gesetzesrang aktualisiert.
Schließlich sei noch erwähnt, dass die Gemeinden, ab Inkrafttreten der Gesetzesänderung, was noch vor Jahresende geschehen sollte, vier Monate Zeit haben, ihre jeweiligen Steuerverordnungen zu ändern.

[value] => El pasado 9 de marzo de 2018 se publicó en el Boletín Oficial de las Cortes Generales la Proposición de Ley mediante la que se modifica el Texto Refundido de la Ley Reguladora de las Haciendas Locales, pues la Sentencia del Tribunal Constitucional de fecha 11 de mayo de 2017 declaró inconstitucionales y nulos varios artículos de dicha ley en relación con el impuesto sobre el incremento del valor de los terrenos de naturaleza urbana (comúnmente conocido como “plusvalía municipal”), en la medida en que sometía a tributación situaciones en las que no existían incrementos de valor.
La plusvalía municipal tiene por objeto gravar el incremento de valor de los terrenos urbanos entre su fecha de adquisición y la de su transmisión. Sin embargo, debido a su método objetivo de valoración (tomando los valores catastrales del suelo), ha llegado incluso también a satisfacerse en casos en los que había una pérdida de valor. Como consecuencia de la Sentencia indicada, la Proposición introduce un nuevo supuesto de no sujeción para los casos en los que el sujeto pasivo acredite que no ha obtenido incremento de valor alguno. Esta acreditación se realizará mediante la diferencia entre los valores reales de transmisión y adquisición del terreno. A tal efecto, se tomarán los valores efectivamente satisfechos respectivamente en la adquisición y transmisión, es decir, los valores indicados en las escrituras o, los comprobados por la Administración Tributaria, en caso que estos últimos fueran superiores.
Además, está prevista la modificación de la determinación de la base imponible; la cual se determinará por coeficientes máximos establecidos en función de los años de titularidad, que serán actualizados anualmente mediante norma con rango legal.
Por último, conviene señalar que desde la entrada en vigor de la modificación de la ley, lo cual debiera suceder antes de que finalice el año, los Ayuntamientos deberán modificar sus respectivas ordenanzas fiscales en un plazo máximo de cuatro meses.
