[value] => Das spanische Gesetz 34/2002 über Dienstleistungen der Informationsgesellschaft und elektronischen Handel untersagt jegliche Versendung von kommerziellen Informationsmaterialien auf elektronischem Wege, die vorher nicht die ausdrückliche Zustimmung des Empfängers erhalten hat. Die Zustimmung der betroffenen Person wird in dem Organschaftlichem Gesetz 15/1999 vom 13. Dezember über den Datenschutz von personenbezogenen Daten als jede freiwillige, unmissverständliche, eindeutige und informierte Willensäußerung, durch die der Betroffene der Verwendung der ihn betreffenden persönlichen Daten zustimmt, definiert. Daraus ergibt sich, dass jede auf dem elektronischen Wege versandte kommerzielle Information ohne vorherige Einwilligung, den Anspruch der ausdrücklichen Zustimmung nicht erfüllen kann.
Die Notwendigkeit einer vorherigen ausdrücklichen Zustimmung durch den Empfänger bzgl. der elektronisch versandten Werbemaßnahmen in Spanien folgt grundsätzlich dem Opt-in-Prinzip, mit folgenden Ausnahmen: (i) es existiert bereits ein Vertragsverhältnis zwischen Versender und Empfänger der elektronischen Kommunikation, (ii) die Kontaktdaten des Empfängers wurden auf zulässigem Weg erhalten, (iii) die Werbemaßnahme informiert den Empfänger über Produkte und Dienstleistungen der eigenen Firma, die die dem ursprünglichem Vertragsobjekt ähneln.
Das Gesetz 34/2002 bestimmt ferner Sanktionen für Rechtsverletzungen, die von der Schwere der Verstöße abhängen. Mit schwerwiegenden Verstößen sind massiver, systematischer und beharrlicher Versand an ein und denselben Empfänger innerhalb eines Jahres gemeint. Sie werden mit Strafen in Höhe von 150.001 bis 600.000 EUR sanktioniert. Leichte Verstöße werden dahingegen mit bis zu 30.000 EUR sanktioniert.
Aufgrund der neuen Datenschutz-Grundverordnung, die europaweit am 25.05.2018 in Kraft tritt, ist davon auszugehen, dass sich Anforderungen und Sanktionen noch verschärfen werden.

[value] => La Ley de Servicios de la Sociedad de la Información y de Comercio electrónico, en adelante LSSI, prohíbe la remisión de comunicaciones por vía electrónica que no han obtenido consentimiento expreso del destinatario de las mismas (art 21.1). El consentimiento del interesado se define en la ley Orgánica de Protección de Datos de Carácter Personal, como toda manifestación de voluntad, libre, inequívoca, específica e informada, mediante la que el interesado consienta el tratamiento de datos personales que le conciernen. Por tanto, se considerará carente de consentimiento del destinatario, aquella información comercial remitida al mismo por vía electrónica que no cuente con su previa petición expresa. Esta necesidad es conocida por el principio opt-in, y es, a su vez, producto de la Directiva 2002/58/CE del Parlamento Europeo y del Consejo.
La LSSI establece una excepción a la necesidad de solicitud expresa del interesado (art 21.1), siempre que se dé: (i) la existencia de una relación contractual previa entre el remitente y el receptor de la comunicación comercial electrónica, (ii) la obtención lícita de los datos de contacto del destinatario y (iii) que la comunicación comercial informe sobre productos o servicios de su propia empresa que sean similares a los que inicialmente fueron objeto de contratación con el cliente.
En cuanto a las sanciones derivadas de la remisión de comunicaciones comerciales no solicitadas en España, la LSSI establece distintos tipos. Por un lado, las infracciones graves correspondientes a envíos masivos de comunicaciones comerciales que rondan las multas de 150.000 y 600.000 euros dependiendo las circunstancias. En cuanto a las infracciones leves, lo serán aquellas comunicaciones comerciales electrónicas que no sean graves y cumplan los requisitos de la LSSI (art 21). Estas multas pueden ascender a 30.000 euros.
