[value] => Ein erneutes Verfahren wegen eines weiteren möglichen Marktmissbrauchs im Umgang mit Nutzerdaten wurde gegen Facebook durch das Bundeskartellamt eingeleitet (Meldung des Bundeskartellamts vom: 19.12.2017).
Es handelt sich hierbei um das bislang wichtigste Verfahren im Kartellrecht, seit der 9. Novelle des Gesetzes gegen Wettbewerbsbeschränkungen (GWB).
Der Vorwurf gegen das Unternehmen ist auf den Umgang mit Nutzerdaten aufgrund der bestehenden marktbeherrschenden Stellung bezogen. Die Teilnahme am Facebook-Netzwerk setzt eine Registrierung und eine uneingeschränkte Zustimmung zu den Nutzungsbedingungen zwingend voraus. Dabei wird die Nutzung des Netzwerks u.a. davon abhängig gemacht, dass Facebook unbegrenzt jegliche Art von Nutzerdaten aus Drittquellen sammeln, den Facebook-Konten der Nutzer zuordnen und zu zahlreichen Datenverarbeitungsvorgängen verwenden kann. Dies geschieht sogar schon dann, wenn man eine entsprechende Seite aufgerufen hat und den „Gefällt Mir-Button“ gar nicht nutzt, dieser auf der Seite aber eingebettet ist.
Das Bundeskartellamt konzentriert sich in dem Verfahren auf die Sammlung und Verwendung von Nutzerdaten aus Drittquellen und arbeitet hinsichtlich der datenschutzrechtlichen Bewertungen eng mit Datenschutzbehörden zusammen und wegen der grenzüberschreitenden Bedeutung des Verfahrens steht das Bundeskartellamt auch mit der Europäischen Kommission in engem Kontakt.
Im Rahmen dieser Missbrauchskontrolle werden verschiedene Fallgruppen missbräuchlichen Verhaltens geprüft. Eine dieser Fallgruppen ist auch der im vorliegenden Fall relevante sog. Konditionenmissbrauch (§ 19 Abs. 2 Nr. 2 und 3 GWB). Geprüft wird hierbei, ob die von einem marktbeherrschenden Unternehmen verlangten Konditionen (Geschäftsbedingungen) miss-bräuchlich sind, weil sie andere Marktteilnehmer ohne sachlichen Grund behindern. Im Kern läuft die Prüfung auf eine Interessenabwägung hinaus. Dies ist auch im Kontext der in den Mitgliedstaaten ab Mai 2018 unmittelbar geltenden Datenschutzgrundverordnung (DSGVO) zu sehen. Eine abschliessende Entscheidung wird im Sommer 2018 mit Spannung von den Wettbewerbshütern erwartet.

[value] => Según el Tribunal de la Defensa de la Competencia en Alemania, una vez más se ha iniciado un nuevo proceso contra Facebook por un posible abuso del mercado en el trato de los datos de sus usuarios. (Noticia del 19.12.2017 del Bundeskartellamt). Se trata del proceso más importante desde la 9. Novela de la ley contra restricción de la competencia (en alemán GWB).
La acusación contra la compañía se refiere al tratamiento de los datos de los usuarios por su posición dominante en el mercado. Para participar e inscribirse en Facebook y la red social es obligatorio registrarse antes y aceptar las condiciones de uso. El uso de la red social implica el uso de los datos de sus usuarios, incluidos los de fuentes ajenas a Facebook, pero que mantienen una relación con sus usuarios y que procesan sus datos sin que ellos sean conscientes de este procedimiento.
Ese proceso surge automáticamente cuando se abre una página web que contiene el botón “me gusta” aunque no se use.
En el proceso actual el Tribunal de la Defensa de la Competencia se centra mayoritariamente en la problemática de la recogida y el uso de los datos procedentes de las fuentes ajenas. También mantiene un estrecho contacto con la administración de protección de datos y, además, con la Comisión Europea por la importancia transfronteriza.
En el marco de dicho control de abuso, se puede llegar a constatar distintos tipos. Uno de los casos comprobados es el “abuso de las condiciones” (§ 19 Abs. 2 Nr. 2 und 3 GWB) que se centra en la revisión de las condiciones generales porque dificultan a otras compañías que participan en el mercado.
En el fondo se trata de sopesar los intereses, teniendo en consideración la nueva directiva de protección de datos que entró en vigor en mayo de 2018.
Las autoridades en materia de competencia están esperando con gran expectativa una decisión final para el verano 2018.
