[value] => Kaum jemand wird widersprechen, wenn gesagt wird, dass Verwaltungs-verfahren häufig sehr bürokratisch und langwierig sind. Und erst recht gilt dies, wenn der Betroffene eine Verwaltungsentscheidung im Ausland benötigt.
Im Bereich der Dienstleistungserbringung hat die EU-Kommission jetzt den Versuch unternommen, die Berufsausübung in anderen EU-Mitgliedsstaaten einfacher zu machen. Stichwort: Dienstleistungskarte. Darunter darf man sich zwar nicht vorstellen, dass ein Dienstleister seine berufliche Befähigung mittels einer Art Scheckkarte nachweisen können wird. Der Begriff bezeichnet vielmehr ein elektronisches Verfahren, an dessen Ende der Dienstleister eine elektronische Bestätigung erhält. Diese Bestätigung sagt aus, dass der Dienstleister in seinem Herkunftsland die Voraussetzungen für die Berufsausübung erfüllt.
Der Aufnahme-mitgliedstaat, in dem der Dienstleister vorübergehend seine Tätigkeit ausüben möchte, darf nicht mehr verlangen, dass sich der Dienstleister noch in ein Register eintragen muss. Ist beabsichtigt, im Aufnahmestaat eine Niederlassung zu gründen, sind allerdings Registrierungspflichten wie beispielsweise die Eintragung im Handelsregister zu beachten. Die Dienstleistungskarte soll allerdings im ersten Schritt nur für einige Berufsgruppen gelten, nämlich die Unternehmens- und Baudienstlei-stungen, also z.B. IT-Berater, Übersetzer, Unternehmensberater, Ingenieure. Zudem gewährt die Dienstleistungskarte keinen Anspruch auf Berufsausübung im Aufnahmemitgliedstaat. Dieser kann die Ausübung der Tätigkeit untersagen, muss dies allerdings begründen.
Mit der Dienstleistungskarte soll die europäische Integration gefördert werden. Ob sie allerdings in dieser Form tatsächlich kommt, bleibt der weiteren politischen Diskussion überlassen. Umstritten ist das Verordnungs- und Richtlinienprojekt allemal.

En el ámbito de la prestación de servicios, la Comisión Europea ha intentado ahora facilitar la actividad profesional en otros Estados miembros de la UE. Palabra clave: tarjeta de servicios. Sin embargo, bajo la misma no puede imaginarse que un proveedor de servicios pueda demostrar su cualificación profesional a través de una especie de tarjeta bancaria. Más bien, el término hace referencia a un procedimiento electrónico en el que el proveedor del servicio recibe una confirmación electrónica a su terminación. Esta confirmación determina que el proveedor del servicio cumple con los requisitos para el ejercicio de su actividad profesional en su país de origen.
El Estado miembro de acogida en el que el proveedor del servicio pretende ejercer temporalmente su actividad ya no podrá exigir que el proveedor del servicio deba aún inscribirse en un registro. Sin embargo, si se pretende abrir una sucursal en el país de acogida, deben respetarse los requisitos de registro, como la inscripción en el Registro Mercantil. La tarjeta de servicios resultará, no obstante, únicamente aplicable en una primera etapa a determinados grupos profesionales, señaladamente a los servicios de rendimiento de negocios y de construcción, es decir, p. ej. asesores informáticos, traductores, consultores de empresa, ingenieros. Además, la tarjeta de servicios no confiere un derecho al ejercicio de la actividad profesional en el Estado miembro de acogida. Esto puede prohibir el ejercicio de la actividad, pero sin embargo debe estar justificado. La tarjeta de servicios está destinada a promover la integración europea.
No obstante, si realmente llega en esta forma queda en manos de las discusiones políticas. De cualquier forma, el proyecto de reglamento y directiva resulta controvertido.
