[value] => „Die unterliegende Partei hat die Kosten des Rechtsstreits zu tragen“ – so steht es in der deutschen Zivilprozessordnung. Der Verlierer hat der obsiegenden Partei danach nicht nur verauslagte Gerichtskosten sondern auch Anwaltsgebühren zu erstatten. Das gilt aber nur, „soweit sie zur zweckentsprechenden Rechtsverfolgung oder Rechtsverteidigung notwendig waren“. Darüber, was nun „notwendig“ und „zweckentsprechend“ ist, wird häufig gestritten. Gerichtlich bestätigt ist beispielsweise, dass Gebühren, die über die gesetzlichen Mindestgebühren des Rechtsanwaltsvergütungsgesetzes hinausgehen (bspw. nach Stundensätzen), grundsätzlich nicht „notwendig“ und damit auch nicht gegenüber der anderen Partei erstattungsfähig sind.
In einem Verfahren vor dem BGH stritten die Parteien nun aber über Reisekosten des Anwalts. Die obsiegende Partei, eine spanische Fluggesellschaft, wollte von der unterlegenen Gegenseite auch die Reisekosten ihres Anwalts erstattet bekommen. Dieser war vom Sitz seiner Kanzlei in Hamburg aus zum Termin nach Erding, nahe München gereist. Die unterlegene Partei argumentierte mit einer Norm aus der Zivilprozessordnung, dass Reisekosten des Anwalts üblicherweise nicht zu erstatten sind, wenn dieser nicht seinen Sitz im Bezirk des Gerichts hat – außer, ja außer, die Zuziehung war zur „zweckentsprechenden Rechtsverfolgung oder Rechtsverteidigung notwendig“.
Der BGH entschied im Sinne der Fluggesellschaft (Beschluss v. 04.07.2017, Az. X ZB 11/15). Die Kosten des „ortsfremden“ Anwalts waren notwendig. Der ausländischen Prozesspartei ist es nicht zuzumuten, „die Wahl des deutschen Rechtsanwalts am Sitz des Prozessgerichts auszurichten“. Sie darf ihren deutschen Vertrauensanwalt frei wählen und diesen zu den jeweiligen Terminen reisen lassen, ohne dass ihr die Kostenerstattung verwehrt wäre. Diese Information dürfte für ausländische Unternehmen bei der Wahl ihres Rechtsvertreters in Deutschland nicht uninteressant sein.

El perdedor tiene que reembolsar a la parte ganadora también los honorarios de los abogados. Sin embargo, esto solo se aplica “en la medida en que sean necesarios para llevar a cabo las acciones pertinentes y la defensa legal”. A menudo se discute qué debe entenderse por “necesario” y “pertinente”. Los tribunales han confirmado, p. ej., que aquellos honorarios que excedan las tarifas mínimas establecidas en la Ley Federal Alemana de Honorarios para Abogados (p. ej. tarifas por horas) no son “necesarios” y, por lo tanto, no son reembolsables a la otra parte.
En un procedimiento reciente ante el Tribunal Federal Supremo alemán se discutía sobre los gastos de viaje del abogado. La parte ganadora, una aerolínea española, solicitaba a la parte contraria el reembolso de los gastos de viaje de su abogado. Éste se había desplazado al juicio en Erding, cerca de Múnich, desde su despacho en Hamburgo. La parte perdedora argumentó en virtud de la norma de la ZPO que los gastos de viaje del abogado no eran normalmente reembolsables en aquellos casos en los que éste no tenía su domicilio profesional dentro del distrito del Tribunal, salvo que “éstos se consideraran necesarios para llevar a cabo las acciones pertinentes y la defensa legal”.
El Tribunal falló a favor de la aerolínea (S. de 04/07/2017, X ZB 11/15). Los gastos del abogado “no residente” fueron considerados como necesarios. A la parte extranjera de un procedimiento no se le puede exigir “la elección de un abogado alemán que tenga su domicilio profesional en la sede del Tribunal que conoce del asunto”. Ésta puede elegir libremente a su abogado, al que se le permitirá ir a todas las citas judiciales, sin que se vea privada de su derecho a reembolso por los gastos derivados de dichos desplazamientos. Esta información no debe pasar desapercibida a las empresas extranjeras a la hora de elegir a su abogado en Alemania.
