[value] => Im spanischen Arbeitsrecht ist die Betriebszugehörigkeit eines Mitarbeiters von großer Relevanz, da die Abfindung im Fall einer Kündigung anhand dieser Betriebszugehörigkeit im Unternehmen berechnet wird. Während im Fall eines einzigen unbefristeten Vertrages die Bestimmung der Betriebszugehörigkeit keine Probleme aufweist, gestaltet sich die Berechnung bei mehreren aufeinanderfolgenden befristeten Verträgen mit demselben Unternehmen schwieriger. Grundsätzlich wird in diesen Fällen eine Betriebszugehörigkeit seit Beginn des ersten Vertrages anerkannt, soweit eine Verbindung zwischen den aufeinanderfolgenden Verträgen besteht. Fraglich ist daher, wann diese Verbindung unterbrochen wird, mit der Folge, dass bei Berechnung der Betriebszugehörigkeit nicht alle aufeinanderfolgenden befristeten Verträge berücksichtigt werden.
In einem jüngst ergangenen Urteil hatte der Oberste Gerichtshof (21. September 2017) darüber zu entscheiden, ob eine Untätigkeit von dreieinhalb Monaten zwischen zwei Verträgen zu einer Unterbrechung der Verbindung führt. In dem konkreten Sachverhalt war die Arbeitnehmerin seit dem Jahr 2002 aufgrund aufeinanderfolgender befristeter Verträge tätig, zwischen denen keine oder nur kurze Unterbrechungen erfolgten, mit Ausnahme des genannten Zeitraums von dreieinhalb Monaten. Der Oberste Gerichtshof erkennt eine Verbindung an, soweit die Zeiträume der Untätigkeit zwischen befristeten Verträgen “im Hinblick auf die Gesamtdauer der erbrachten Dienstleistungen nicht relevant sind”. Folglich berücksichtigt er im vorliegenden Fall die Betriebszugehörigkeit seit dem ersten der befristeten Verträge, trotz der Unterbrechung von dreieinhalb Monaten.
Zudem hat der Oberste Gerichtshof bereits in früheren Urteilen klargestellt, dass die Beziehung von Arbeitslosengeld während des Zeitraums der Untätigkeit oder die Unterzeichnung der Endabrechnung zwischen zwei aufeinanderfolgenden Verträgen Umstände sind, die für sich betrachtet nicht zu einer Unterbrechung der Verbindung zwischen den Verträgen führen.

[value] => El cómputo de la antigüedad de un empleado es muy relevante en el derecho laboral español, debido a que la indemnización en caso de despido se calcula con base en dicha antigüedad en la empresa. Mientras que en el caso de un único contrato de duración indefinida, el cómputo de la antigüedad no presenta mayores problemas, el cálculo es más difícil en el supuesto de sucesivos contratos temporales suscritos con la misma empresa. Como regla general, en estos supuestos, la antigüedad se computa desde el primer contrato temporal, siempre que exista una unidad de vínculo entre los sucesivos contratos. Por lo tanto, se plantea la cuestión de cuándo se rompe dicha unidad de vínculo, con la consecuencia de que no se tienen en cuenta todos los contratos temporales sucesivos a los efectos de computar la antigüedad.
En una reciente sentencia (STS de 21 de septiembre de 2017), el Tribunal Supremo tuvo que decidir si una ruptura de tres meses y medio entre dos contratos puede causar que se quiebre la unidad esencial del vínculo. En el supuesto concreto, la empleada venía prestando sus servicios desde el año 2002 a través de sucesivos contratos temporales entre los que mediaban pocos o ningún día de interrupción, con la excepción del mencionado periodo de tres meses y medio. El Tribunal Supremo reconoce la unidad del vínculo siempre que los periodos de inactividad entre los contratos temporales “carezcan de relevancia en relación con la duración total de los servicios prestados”. Como consecuencia, en el caso concreto, computa la antigüedad de la trabajadora desde el primero de los contratos temporales, a pesar de la interrupción de tres meses y medio que hubo entre dos de ellos.
Asimismo, el Tribunal Supremo ha aclarado ya en anteriores sentencias, que el mero hecho de que se haya cobrado la prestación por desempleo durante el periodo de inactividad, o la simple firma de recibos de finiquitos entre los sucesivos contratos, son circunstancias que, individualmente consideradas, no implican ruptura del vínculo contractual.
