[value] => Gemäß §14.2.2 TzBfG muss ein sachlicher Grund für die Befristung eines Arbeitsverhältnisses vorliegen. Die Befristung ohne sachlichen Grund ist nach dem gesetzlichen Wortlaut nur dann zulässig, wenn es sich um eine Neueinstellung handelt. War der betroffene Mitarbeiter bereits beim Arbeitgeber vorbeschäftigt, ist eine Befristung ohne sachlichen Grund ausgeschlossen.
Mit Urteil v. 6.4.11 schränkte das BAG das Vorbeschäftigungsverbot zeitlich ein und bestimmte, dass Arbeitgeber Verträge ohne sachlichen Grund befristen können, wenn 3 Jahre zuvor kein Arbeitsverhältnis mit demselben Arbeitnehmer bestand. Die Rechtsprechung bewertet den Ablauf eines Zeitraums von mehr als 3 Jahren als Neueinstellung und begründete seine Ansicht mit dem „nicht eindeutigen“ Wortlaut des Gesetzes. War ein Arbeitnehmer allerdings vor weniger als 3 Jahren im Betrieb angestellt, dann liegt keine Neueinstellung vor, sodass eine Befristung ohne sachlichen Grund ausgeschlossen bleibt.
Diese Entscheidung des BAG rief erhebliche Kritik hervor.
Nach Auffassung des LAG Baden-Württemberg sei §14.2.2 TzBfG nicht auslegungsfähig. Der Gesetzgeber habe bewusst keine Einschränkung ins Gesetz aufgenommen. Das normierte Vorbeschäftigungsverbot gilt dem Wortlaut nach vielmehr absichtlich zeitlich uneingeschränkt.
Auf Grund der unsicheren Rechtslage sollten sich Arbeitgeber bereits jetzt darauf einstellen, dass die zeitliche Begrenzung gem. der Rechtsprechung, auf den Zeitraum von 3 Jahren, in Kürze möglicherweise keine Anwendung mehr findet und beachten, dass die Arbeitsverhältnisse vielmehr nur mit sachlichem Grund befristet werden sollten, wenn die betroffenen Arbeitnehmer in der Vergangenheit bereits in einem Arbeitsverhältnis mit dem Arbeitgeber standen. Darüber hinaus ist den Arbeitgebern zu empfehlen, bei Einstellungen ausdrücklich nach einer Vorbeschäftigung beim gleichen Arbeitgeber, zB in einer anderen Abteilung, zu fragen.
Mit großer Spannung bleibt nun abzuwarten, ob das BAG seine Rechtsprechung revidieren wird.

[value] => Según el § 14.2.2 TzBfG (ley alemana de contratación temporal), la temporalidad de un contrato laboral requiere una causa explícita. Según el texto literal de la citada ley solo los casos de nueva contratación permiten la limitación sin motivo. Cuando un empleado estuvo previamente contratado por la empresa, la temporalidad sin motivo queda excluida.
Mediante sentencia de 6 de abril de 2011, el Tribunal Federal de Trabajo suavizó la prohibición y estipuló que los empresarios pueden firmar contratos temporales sin indicación del motivo si durante los últimos 3 años a la contratación no hubo relación laboral con el mismo empleado. El Tribunal consideró el traspaso de 3 años suficiente como para clasificarlo de nueva contratación y justificó que su posición encajaba en el ámbito de la redacción “ambigua” de la ley. No obstante lo anterior, cuando un empleado hubiera trabajado hace menos de 3 años en la misma empresa, entonces no cabe la posibilidad de aplicar la “suavización” de la prohibición.
La citada sentencia fue criticada por varios tribunales.
Según el Tribunal Regional de Baden-Württemberg, la ley no ofrece margen para su interpretación. El legislador conscientemente no redactó ninguna restricción de la ley. La prohibición general de acordar contratos temporales sin motivación cuando ya hubo una contratación previa ha de aplicarse en todos los casos.
Debido a la discusión, los empresarios alemanes deberían mentalizarse que la “suavización” puede dejar de aplicarse en breve – es decir, dejaría de justificar una contratación temporal sin causa o motivo. Además, se recomienda que los empresarios soliciten la información sobre si ha habido una contratación previa, por ejemplo, en otro departamento.
Quedamos a la espera si el Tribunal Federal va a revisar su jurisdicción y dé el giro e impedirá la contratación temporal sin motivo cuando hubo contratación previa.
