Mai 2017 begann der sogenannte „Wannacry“, bei dem ein Virus auf Windows Microsoft Systeme von über 350.000 Betreibern auf der ganzen Welt geschickt wurde - darunter auch große Firmen wie die Fluggesellschaft LATAM, die Deutsche Bahn, Fedex, der nationale Gesundheitsdienst Großbritanniens sowie die spanische Telefongesellschaft.
Der Virus verteilte sich über einen Dropper, welcher an eine E-Mail angehängt war und vom Antivirus nicht erkannt wurde. Er konnte sich deshalb so schnell verbreiten, weil die infizierten Geräte nach anderen Anschlüssen suchten, um auch diese zu infizieren. Der Virus verlangte 300 € für die Entschlüsselung jedes betroffenen Ordners. Um die „Lösegeldforderung“ einzutreiben, erstellten sich die Angreifer verschiedene Benutzerkonten, mit denen sie Bitcoins empfangen konnten. Auf diese Weise konnten sie die Zahlungen ihrer Opfer erhalten, ohne dabei ihre Identität preiszugeben. Schätzungsweise sind auf diese Weise bis zum 19. Mai 2017 über 200 Zahlungen eingegangen, welche sich insgesamt auf $ 72,144.76 summieren.
Das spanische Strafgesetzbuch beinhaltet keine spezifische Norm, welche diese immer häufiger auftretende kriminelle Handlung unter Strafe stellt. Bis heute gibt es nur ein Urteil des spanischen Strafgerichtshofs aus dem Jahr 2016, in dem zu einem ähnlichen Sachverhalt festgestellt wurde, dass die strafbare Handlung der „Computererpressung“ unter verschiedene Delikte des Strafgesetzbuchs subsumiert werden kann. Möglich seien Erpressung, Herbeiführung von Computerschäden, Geldwäsche, Zugehörigkeit zu einer kriminellen Organisation sowie die Verletzung der Privatsphäre.
Kriminelle Organisationen machen sich die Fortschritte und Entwicklungen der Technologie zunutze, um strafbare Handlungen durchzuführen, welche bis vor kurzem noch undenkbar waren. Um diesen neuen Bedrohungen gerecht zu werden, ist eine Reform des Strafgesetzbuches unabdingbar.

Este virus se distribuyó a través de un dropper enlazado a un correo electrónico que no fue detectado por los antivirus. Se pudo extender con rapidez porque los dispositivos infectados buscaban otros conectados a él para afectarles. Este virus solicitaba 300 dólares para desencriptar los archivos de cada ordenador infectado. Para poder cobrar estos “rescates” los autores del ataque crearon varias direcciones de bitcoin que fueron usadas para recibir los pagos de las víctimas y que les permitía permanecer en el anonimato. A fecha 19 de mayo de 2017, se estima se habían efectuado más de 200 pagos, los cuales acumulaban $72,144.76.
El Código Penal español no contiene un delito específico que incluya esta actuación criminal cada vez más frecuente. Hasta la fecha existe una única Sentencia de la Audiencia Nacional del año 2016 donde en un tema similar la conducta de “secuestro informático” podría ser constitutiva de varios delitos, entre ellos, un delito de extorsión, un delito de daños informáticos, delito de blanqueo de capitales, delito de pertenencia a organización criminal y un delito contra la intimidad.
La tecnología y los avances informáticos están sirviendo a organizaciones criminales para llevar a cabo actividades delictivas hasta hace poco insospechadas. En consecuencia, el Derecho Penal está obligado a reformarse e innovar para incluir de manera clara este tipo de amenazas.
