[value] => In den Ausgaben November 2014 und September 2016 dieses Newsletters hatte der Verfasser bereits über die Frage berichtet, ob eine Rechnung auch dann die in formeller Hinsicht erforderliche (§ 14 Abs. 4 Satz 1 Nr. 1 UStG) vollständige Anschrift des leistenden Unternehmers enthält, wenn es sich bei der darin angegebenen Anschrift um einen reinen Briefkasten- bzw. Scheinsitz handelt, an dem sich keine eigenen Geschäftsräume befinden bzw. keine geschäftlichen Aktivitäten stattfinden.
Auf die dort erwähnte Vorlage beider für die Umsatzsteuer zuständigen Senate des Bundesfinanzhofs (BFH) hat der Europäische Gerichtshof (EuGH) nun in zwei jüngst veröffentlichen Urteilen vom 15.11.2017 (C-374/16 und C-375/16) zu den formalen Anforderungen an eine ordnungsgemäße Rechnung Stellung genommen. Hiernach ist die Ausübung des Rechts auf Vorsteuerabzug nach Art. 168 Buchstabe a und Art. 178 Buchstabe a in Verbindung mit Art. 226 Nr. 5 der Richtlinie 2006/112/EG über das gemeinsame Mehrwertsteuersystem nicht davon abhängig, dass in einer Rechnung eine Anschrift angegeben ist, unter welcher der Rechnungsaussteller seine wirtschaftliche Tätigkeit ausübt, vielmehr reicht es aus, dass er unter dieser Adresse postalisch erreichbar ist, so dass eine sog. Briefkastenadresse ausreicht. Aus den Urteilsgründen ergibt sich jedoch auch, dass die Angabe einer reinen Schein- oder Fantasieadresse für den leistenden Unternehmer nicht den gesetzlichen Anforderungen für den Vorsteuerabzug genügt, da der Vorsteuerabzug nur bei zusätzlicher Erfüllung der materiellen gesetzlichen Anforderungen zu gewähren ist.
Hinsichtlich der weiteren Vorlagefrage beider BFH-Senate, unter welchen Umständen der Vorsteuerabzug auch einem gutgläubigen Rechnungsempfänger zusteht, wenn die formellen Rechnungsanforderungen nicht erfüllt sind, hat der EuGH auf sein Urteil in der Rechtssache Senatex verwiesen und dieses hierdurch erneut bestätigt (C-518/14 vom 15.09.2016, vgl. hierzu auch die Beiträge des Verfassers zu den Ausgaben Januar und Juni 2017 dieses Newsletters).

[value] => En las ediciones de noviembre 2014 y septiembre 2016 de este boletín, el autor informó sobre la duda de que una factura contiene la exigida dirección completa del expedidor (§ 14 (4) frase 1 núm. 1 LIVA alemana), cuando la es un simple buzón o bien la de una sede ficticia, en la cual no se encuentran oficinas propias ni tiene actividad comercial.
En relación a la cuestión prejudicial allí mencionada, planteada por los dos Senados del Tribunal Supremo de lo Fiscal (BFH) competentes en materia de IVA, el Tribunal de Justicia de la Unión Europea (TJUE) se ha pronunciado en dos sentencias de fecha 15/11/2017 (C-374/16 y C-375/16), publicadas recientemente, sobre los requisitos de una factura correcta.
Según éstas, el ejercicio del derecho a la deducibilidad del IVA de conformidad con el art. 168 letra a y art. 178 letra a, en conexión con el art. 226 núm. 5 de la Directiva 2006/112/CE relativa al sistema común del IVA no depende de una dirección bajo la cual el expedidor de la factura lleve a cabo su actividad comercial, en realidad es suficiente con que él sea localizable por vía postal en dicha dirección, de modo que la dirección de un buzón es suficiente. De la motivación de la sentencia se desprende también que la indicación de una dirección puramente ficticia o inventada no es suficiente para el expedidor de la factura para deducir el IVA repercutido, ya que la deducción del IVA repercutido solamente debe concederse en el caso de que se cumplan con los requisitos materiales adicionales que dispone la ley.
En cuanto a la otra cuestión prejudicial de ambos Senados del BFH en cuáles circunstancias le corresponde la deducción del IVA repercutido a un destinatario de la factura que haya actuado de buena fe si los requisitos formales de la factura no se han cumplido, el TJUE ha hecho remisión a su sentencia en el asunto Senatex y ha confirmado nuevamente ésta por medio de la presente (C-518/14 de fecha 15/09/2016, véase a este respecto también las aportaciones del autor en las ediciones de enero y junio 2017 de este boletín).
