[value] => Am 20. Dezember letzten Jahres haben wir endlich das Urteil des Europäischen Gerichtshofes (EuGH) im Streit zwischen UBER und einem spanischen Berufsverband von Taxifahrern erhalten.
Nach mehreren Jahren des Rechtsstreits erklärt der EuGH schließlich, dass UBER nicht als Vermittlungsgesellschaft im Sinne des Gemeinschaftsrechts angesehen werden kann, da sie darauf abzielt, mittels einer Smartphone-Applikation und gegen Entgelt, eine Verbindung zwischen Fahrern, die das eigene Fahrzeug benutzen, und Personen, die eine Fahrt im innerstädtischen Bereich unternehmen möchten, herzustellen, dass „als mit einer Verkehrsdienstleistung untrennbar verbunden anzusehen und daher als Verkehrsdienstleistung zu verstehen ist“, so dass UBER eine entsprechenden Lizenz erhalten muss.
Der EuGH weist darüber hinaus darauf hin, dass UBER einen entscheidenden Einfluss auf die Bedingungen, unter denen diese Fahrer die Leistung erbringen, ausübt. Dabei ist insbesondere klar ersichtlich, dass UBER durch die gleichnamige Anwendung zumindest den Höchstpreis für die Fahrt festsetzt, dass diese Gesellschaft den Preis beim Kunden erhebt und danach einen Teil davon an den Fahrer des Fahrzeugs überweist und dass sie eine gewisse Kontrolle über die Qualität der Fahrzeuge und deren Fahrer ausübt.
Das Urteil ist von einigen mit Begeisterung und von anderen mit Sorge erhalten worden. Einige ähnliche Dienste könnten in Zukunft im Rampenlicht stehen, z. B. kollaborative Wirtschaftsplattformen wie Deliveroo (Lieferung von Lebensmitteln nach Hause) oder Airbnb (Beherbergungsbetriebe). UBER hat erklärt, dass sich an ihrem Service nichts ändern wird, da es seit 2016 in Spanien mit VTC-Lizenzen (Vermietung von Fahrzeugen mit Fahrer) operiert. Dies ist jedoch ein schwerer Rückschlag für UBER‘s früheres System, das aus einer digitalen Plattform für Fahrten im städtischen Umfeld mit lokalen Fahrern bestand, ohne die entsprechende Lizenz zu besitzen.

[value] => El 20 de diciembre del año pasado obtuvimos finalmente la sentencia del Tribunal de Justicia de la Unión Europea (TJUE) en la disputa entre UBER y una asociación española de taxistas.
Tras varios años de litigio, el TJUE declara finalmente que UBER no puede ser considerada a los efectos del derecho comunitario como un empresa intermediaria, habida cuenta de que tiene por objeto conectar, mediante una aplicación para teléfonos inteligentes, a cambio de una remuneración, a conductores no profesionales que utilizan su propio vehículo con personas que desean efectuar un desplazamiento urbano, lo que está “indisociablemente vinculado a un servicio de transporte y, por lo tanto, ha de calificarse de servicio en el ámbito de los transportes”, debiendo UBER operar con la correspondiente licencia.
El TJUE indica asimismo que UBER ejerce una influencia decisiva sobre las condiciones de las prestaciones efectuadas por sus conductores, ya que consta, en particular, que UBER establece al menos el precio máximo de la carrera, que recibe este precio del cliente para después abonar una parte al conductor, que ejerce cierto control sobre la calidad de dichos vehículos, así como sobre la idoneidad y el comportamiento de los conductores.
La sentencia ha sido recibida con entusiasmo por algunos y con preocupación por otros. Algunos servicios similares podrían estar en el punto de mira en el futuro, por ejemplo, las plataformas de economía colaborativa como Deliveroo (entrega de comida a domicilio) o Airbnb (alojamiento turístico). UBER ha declarado que nada cambiará en su servicio ya que desde 2016 opera en España con licencias VTC (arrendamiento de vehículos con conductor), no obstante, sí es un serio revés para su sistema anterior, que se caracterizaba por ser una plataforma digital para compartir trayectos en entorno urbano con conductores locales, sin contar con la correspondiente licencia.
