[value] => Mit dem Gesetz über die Durchführung der gegenseitigen Amtshilfe in Steuersachen zwischen den Mitgliedstaaten der Europäischen Union (EU-Amtshilfegesetz - EUAHiG) wurde in Deutschland die Richtlinie 2011/16/EU vom 15.02.2011 über die Zusammenarbeit der Verwaltungsbehörden im Bereich der Besteuerung umgesetzt. Nach Art. 12 EUAHiG kann auf Vorschlag des für einen Steuerfall zuständigen Finanzamts das Bundeszentralamt für Steuern (BZSt) mit einem oder mehreren Mitgliedstaaten der EU vereinbaren, im jeweils eigenen Hoheitsgebiet eine gleichzeitige Prüfung einer oder mehrerer Personen von gemeinsamem oder ergänzendem Interesse durchzuführen.
In einem Verfahren des einstweiligen Rechtsschutzes hatte das Finanzgericht (FG) Köln über die Frage zu entscheiden, ob das für eine deutsche Tochtergesellschaft zuständige Finanzamt über eine im Sitzstaat ihrer Muttergesellschaft gleichzeitig durchzuführende Betriebsprüfung der niederländischen Finanzbehörden Informationen über eine in Hongkong ansässige Schwestergesellschaft erlangen kann. Das Finanzamt hatte unter Rückgriff auf öffentlich zugängliche Datenquellen argumentiert, dass es Indizien dafür gäbe, dass über die Gestaltung der Verrechnungspreise in erheblichem Umfang Gewinne in die niedrig besteuerte Schwestergesellschaft nach Honkong verlagert worden seien. Die deutsche Gesellschaft hatte argumentiert, dass sie rechtlich keine Möglichkeit habe, ihre Schwestergesellschaft zur Herausgabe ihrer Jahresabschlüsse zu zwingen.
Im jüngst veröffentlichten Beschluss vom 23.05.2017 (2 V 2498/16) hat das FG Köln festgestellt, dass die deutschen Finanzbehörden nach Ausschöpfung aller inländischen Ermittlungsmöglichkeiten berechtigt sind, eine gleichzeitige Betriebsprüfung bei der Muttergesellschaft zu vereinbaren, da die Bilanzinformationen nach Sachlage für die steuerliche Veranlagung der deutschen Gesellschaft voraussichtlich erheblich seien und die Muttergesellschaft Auskunft über die Frage geben könne, in welchem Umfang Gewinne bei den jeweiligen Konzerngesellschaften angefallen sind.

[value] => Con la Ley sobre asistencia mutua en materia fiscal entre los Estados de la Unión Europea (EU-Amtshilfegesetz - EUAHiG) fue implementada la Directiva 2011/16/UE de fecha 15/02/11 relativa a la cooperación administrativa en el ámbito de la fiscalidad. En conformidad con el Art. 12 EUAHiG, a petición de una Delegación de Hacienda Alemana competente para un determinado supuesto tributario, puede la Oficina Central de Impuestos alemana (BZSt) acordar con uno o varios estados miembros de la UE llevar a cabo en sus propios territorios nacionales una inspección simultánea de una o varias personas con intereses comunes o complementarios.
En un procedimiento de medidas cautelares, el Tribunal de lo Fiscal (FG) de Colonia debía decidir si la Delegación de Hacienda competente para una filial alemana podía obtener información sobre una compañía asociada residente en Hongkong por medio de una inspección fiscal que se estaba ejecutando simultáneamente en la matriz holandesa. Dicha Delegación argumentó haciendo uso de bases de datos de acceso público de tener indicios de un traslado muy significante de los beneficios por medio de la configuración de los precios de transferencia a la compañía asociada en Honkong, sujeta a baja imposición. La sociedad alemana argumentó que no tenía legalmente ninguna posibilidad de obligar a su compañía asociada a entregar sus cuentas anuales.
En una decisión del 23/05/2017 recién publicada, el FG de Colonia determinó que, tras agotar toda posibilidad de inspección en territorio nacional, las autoridades tributarias alemanas están legitimadas para acordar una inspección fiscal simultánea en la matriz, ya que, previsiblemente las informaciones del balance eran sustanciales para la liquidación de los impuestos de la sociedad alemana y la matriz podría informar en qué medida se habían generado beneficios para las respectivas sociedades del grupo.
