[value] => Die Einführung eines Mechanismus zur Meldung von Mißständen am Arbeitsplatz (Whistleblowing-Hotline) ist eines der grundlegenden Anforderungen, die ein Compliance Programm zur Vorbeugung von strafrechtlichen Risiken gemäß Par. 31 bis des spanischen Strafgesetzbuches erfüllen muss, um eine juristische Person von strafrechtlicher Haftung zu befreien.
Eine Whistleblowing-Hotline kann unternehmensintern sein, wenn sie nur für Mitarbeiter des Unternehmens zugänglich ist, oder öffentlich, wenn sie auch von Dritten genutzt werden kann. Welche Alternative gewählt wird, ist von der Art des Unternehmens und den mit seiner Tätigkeit verbundenen Risiken abhängig. Nach UNE 19601 soll die Whistleblowing-Hotline öffentlich zugänglich sein. In der Tat kann eine öffentliche Hotline nützlich sein, aber das spanische Strafgesetzbuch fordert dieses Merkmal nicht.
Z.Zt. kann von Whistleblowing-Hotlines anonym Gebrauch gemacht werden. Der Gesetzesentwurf für das neue spanische Datenschutzgesetz (LOPD), sieht in Par. 24 vor, daß im Fall von privaten Hotlines Meldungen „sogar anonym“ erfolgen können. Auch die UNE Norm 19601 sieht anonyme Meldungen vor.
Um effektiv zu sein, muss die Hotline die Identität des Informanten und den Inhalt der Information vertraulich behandeln. Die Information darf nur dem Compliance-Beauftragten zugänglich sein. Erst nach den nötigen Ermittlungen und der Feststellung von Indizien, die auf Mißstände schließen lassen, kann die Information an das Verwaltungsorgan und die Personalabteilung weitergegeben werden, zwecks Anwendung entsprechender Maßnahmen. Der erwähnte Par. 24 des Gesetzentwurfes der LOPD sieht vor, dass die Daten bezüglich des Hinweisgebers und der gemeldeten Mißstände nur solange, wie für ihre Auswertung erforderlich, gespeichert werden und in jedem Fall drei Monate nach Meldung gelöscht werden, es sei denn, es ist eine entsprechende Ermittlung im Gang.´
Für das Management der Hotline ist der Compliance-Beauftragte zuständig. Sein Aufgabenbereich ist also durchaus komplex.

[value] => El canal de denuncias es uno de los requisitos necesarios de los programas de prevención de riesgos penales que conforme a lo dispuesto en el art. 31 bis del Código Penal pueden eximir de responsabilidad penal a la persona jurídica.
Estos canales de denuncia pueden ser internos, cuando sólo son accesibles a los empleados, o también abiertos, cuando pueden utilizarlos terceros. La elección de uno u otro tipo de canal dependerá del tipo de empresa y los riesgos asociados a su actividad. La Norma UNE 19601 exige que sean abiertos. Coincidimos en que el canal abierto puede ser más útil, pero no lo exige el Código Penal.
En la actualidad, no cabe duda de que dichos canales de denuncia podrán ser utilizados de forma anónima. El Proyecto de Ley Orgánica de Protección de Datos (LOPD), prevé en su artículo 24 que en los canales de denuncias privados se puedan comunicar hechos “incluso anónimamente”. También la Norma UNE 19601 admite las denuncias anónimas. No obstante, los canales de denuncia no promoverán la presentación de estas denuncias anónimas y evitarán su uso abusivo e injustificado.
Los canales de denuncia para ser eficaces deben garantizar la confidencialidad del denunciante y del contenido de la denuncia. Su información sólo podrá ser conocida por el órgano encargado de vigilar el funcionamiento del sistema de prevención. Sólo tras la tramitación del expediente informativo y la constatación de existencia de indicios de irregularidades se podrá dar traslado al Órgano de Administración y Departamento de Recursos Humanos para la adopción de las medidas necesarias. Precisamente, el art. 24 del Proyecto de LOPD prevé que los datos del denunciante y de los hechos denunciados sólo se conservarán el tiempo imprescindible para su evaluación y, en todo caso. se eliminarán transcurridos 3 meses desde la denuncia, a salvo, claro está, que se hayan incorporado a un expediente de investigación en curso.
Sin duda, la gestión del canal de denuncias es una responsabilidad del Responsable de Cumplimiento y pone de relieve la complejidad de su encargo.
