[value] => Da sich das Deutsch-Spanische Unternehmerforum der AHK am 13.und 14. Juni dieses Jahres mit Forschungs-, Entwicklungs- und Innovationtätigkeiten (F+E+I) beschäftigen wird, möchten wir an dieser Stelle daran erinnern, dass man die Erstattung eines Teils der für derartige im Rahmen der Körperschaftsteuer (IS) in Abzug gebrachte Investitionen beantragen kann. Dies ist ein hervorragendes Mittel, um Liquidität zu erlangen, insbesondere, für Unternehmen, die Verluste verzeichnen oder neu gegründete Gesellschaften.
Unternehmen, die den Wunsch hegen, den F+E-Abzug in Anwendung zu bringen, können diese etwa beantragen, weil diese im Gegensatz zu früher mit einem Betrag in unbegrenzter Höhe in Anwendung gebracht werden. Diese Option bringt eine Ermäßigung von 20% auf den Betrag des Abzugs mit sich. Darüber hinaus, können die Steuerpflichtigen die Erstattung (die sogenannte „Monetisierung“) beantragen, wenn der Abzug nicht angewandt werden kann, weil dieser die abzuführende IS übersteigt. Der vom Finanzamt „zurückzuerstattende“ Betrag darf im Fall von Innovationstätigkeiten nicht mehr als 1 Millionen Euro betragen und der Gesamtbetrag für alle F+E+I -Tätigkeiten ist auf 3 Millionen beschränkt.
Voraussetzung für die Einholung dieser Erstattung durch das Finanzamt, ist neben der Antragsstellung die Einholung entweder eines Berichts, der die F+E+I-Tätigkeiten begründet („informe motivado“) oder einer vorher getroffenen Bewertungsvereinbarung. Dieser „informe motivado“ muss vom Wirtschaftsministerium per Beschluss befürwortet werden. Eine weitere Bedingung ist die der Reinvestition eines Betrages in Höhe des angewandten oder erstatteten Abzugs in F+E+I-Aufwendungen oder in Investitionen in Sachanlagen oder immaterielle Anlagen, die ausschließlich genannten Tätigkeiten zuzuschreiben sind.
Laut Wirtschaftsministerium enden die Fristen für die Bewilligung derartiger informes motivados für das Jahr 2018 im November.

[value] => Aprovechando que la AHK celebra el 13 y 14 de junio de este año el encuentro Hispano-Alemán sobre I+D+i, queremos recordar la posibilidad de solicitar el abono de parte de la deducción generada por inversiones de este tipo en el marco del Impuesto de Sociedades (IS). Esta medida representa un relevante medio adicional para la obtención de liquidez, especialmente para compañías en pérdidas o entidades de reciente constitución.
Las entidades que deseen aplicar la deducción por I+D+i pueden optar porque estas se apliquen sin limitar su importe, cuando históricamente existían ciertos límites. Ahora bien, dicha opción conlleva un descuento del 20% de la deducción. Además, los contribuyentes podrán solicitar el abono (la denominada “monetización”) en el caso de que la deducción no pueda aplicarse por superar esta, el Impuesto que salga pagar. La cantidad a “devolver” por Hacienda no podrá superar 1 millón de euros en el caso de actividades de innovación, y un límite conjunto de 3 millones para las deducciones por actividades en I+D+i.
Uno de los requisitos para obtener dicho pago por parte de Hacienda es que se haya solicitado y obtenido un informe motivado sobre la calificación de la actividad como I+D+i, o un acuerdo previo de valoración. Es importante resaltar que la mera presentación del informe motivado no es válida para la obtención del abono, sino que es necesario que se cuente con una resolución favorable del Ministerio de Economía. Además de lo anterior, es necesario destacar el requisito de reinversión, que impone que se destine un importe equivalente a la deducción aplicada o abonada a gastos de I+D+i o a inversiones en elementos del inmovilizado material o activo intangible exclusivamente a fectos a estas actividades.
Por último, recordamos que para este 2018 y según el Ministerio de Economía los plazos para cerrar los expedientes de solicitud de Informes Motivados para las deducciones fiscales por I+D+i, finalizarán en el mes de noviembre.
