[value] => Viele ausländische Unternehmen überlegen online in den spanischen Markt zu expandieren. Es ist wichtig für jedes hieran interessierte Unternehmen sich der Voraussetzungen bewusst zu sein, die ein Unternehmen erfüllen muss, um den spanischen Markt für Verbraucher erschließen zu können.
Auf der einen Seite steht die Verbraucherschutzverordnung, deren Anwendung in Spanien das Ergebnis der Umsetzung des EU Rechts ist. Die Vorschriften des Landes, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, sind ebenfalls anwendbar, wie in der Verordnung Rom I festgelegt. Aus diesem Grund müssen die allgemeinen Geschäftsbedingungen von Unternehmen, die ein Online-Geschäft in Spanien betreiben wollen, sich an die spanische Gesetzgebung anpassen und eine Reihe von vorvertraglichen Anforderungen erfüllen.
Das Online-Geschäft muss auch den Bestimmungen des spanischen Datenschutzgesetzes, „LOPD“, entsprechen, das die Notwendigkeit der ausdrücklichen vorherigen Zustimmung des Verbrauchers hinsichtlich der Erhebung personenbezogener Daten sowie der Anerkennung seiner Rechte (Recht auf Zugang, Berichtigung, Annullierung oder Widerspruch) festlegt. Außerdem müssen bestimmte Informationen des Unternehmens den Verbrauchern und Behörden zur Verfügung stehen (Adresse der ständigen Niederlassung in Spanien oder E-Mail-Konto, unter anderem). Eine weitere spanische Norm die berücksichtigt werden muss, ist das Gesetz des unlauteren Wettbewerbs, die wettbewerbswidrige Praktiken reguliert.
Auch müssen die Online-Aktivitäten in Spanien mit der Ausstellung von Rechnungen und die entsprechende Zahlung von Steuern beachtet werden.
Schließlich ist zu beachten, dass am 25. Mai 2018 die allgemeinen Vorschriften zum Datenschutz (RGPD) in Kraft treten werden, sodass die Unternehmen sehr aufmerksam auf die Erfüllung ihrer teilweise neuen Verpflichtungen achten sollten.

[value] => Son muchas las empresas que hoy en día desean expandir sus negocios a través del mercado español online. Antes de emprender cualquier tipo de actividad económica a través de este mecanismo, es importante que las empresas profundicen en la normativa y legislación aplicables en España.
Por un lado, está la normativa de protección al consumidor, cuya aplicación en España es el resultado de la transposición de la legislación comunitaria. Son de aplicación, además, las normas del país de residencia habitual del consumidor, según dispone el Reglamento Roma I. Por esa razón, las condiciones generales de las empresas que deseen llevar un negocio online en España deberán adaptarse a la legislación española y cumplir con una serie de requisitos precontractuales.
El negocio online, además, debe cumplir con lo establecido en la Ley orgánica de protección de datos, LOPD, que establece la necesidad del consentimiento previo expreso del consumidor en lo que respecta a la obtención de datos de carácter personal, así como el reconocimiento de los derechos ARCO (derecho de acceso, rectificación, cancelación u oposición). Determinada información de la empresa debe estar a disposición de los usuarios y autoridades (dirección de la oficina permanente en España o cuenta de correo electrónico, entre otros). Otra norma española a tener en cuenta es la Ley de Competencia Desleal, que regula las prácticas anticompetitivas.
Mencionar también que la actividad online en España debe cumplir con la emisión de facturas y el pago correspondiente de impuestos fiscales establecidos.
Por último, recordar que el próximo 25 de mayo de 2018 entrará en vigor el Reglamento General de Protección de Datos (RGPD), por lo que las empresas deberán estar muy atentas en el cumplimiento de sus obligaciones so pena de importantes sanciones.
