[value] => Vor einigen Monaten haben wir uns auf diesen Seiten mit dem Urteil der 1. Kammer (Zivilkammer) des spanischen Obersten Gerichtshofes vom 23. Dezember 2015 befasst, welches eine Klausel eines Hypothekendarlehens, die dem Verbraucher die Kosten der Vertragsschließung, die in Folge der notariellen Beurkundung und der Registrierung des Vertrages entstehen, sowie die Zahlung der Urkundensteuer auferlegte, wegen Missbräuchlichkeit für nichtig erklärte.
Hinsichtlich der Urkundensteuer (“Actos Jurídicos Documentados-IAJD”) generierte das Urteil eine gewisse Polemik, weil es im Widerspruch zu anderen früheren Urteilen der 3. Kammer (Kammer für Verwaltungssachen) des Obersten Gerichtshofes stand, die festgestellt hatten, daß die bei Bestellung einer Hypothek zur Besicherung eines Darlehens anfallende Urkundensteuer gemäß der Steuergesetzgebung vom Darlehensnehmer zu entrichten ist und nicht von der Bank.
Vor kurzem hat sich die 1. Kammer erneut zu diesem Thema geäußert. In diesem Fall weicht sie von ihrer bisherigen Auffassung ab und entscheidet im Einklang mit der von der 3. Kammer vertretenen Auffassung. In den beiden Entscheidungen vom 15. März 2018 (Nr. 147 und 148) urteilt die 1. Kammer, dass unabhängig davon, dass die Verpflichtung des Darlehensnehmers zur Zahlung der Steuer in einer missbräuchlichen und somit nichtigen Klausel enthalten ist, ist der Darlehensnehmer auf jeden Fall zur Zahlung der Steuer verpflichtet, weil er gemäß der Steuergesetzgebung der Steuerpflichtige ist.
Diese neue Auslegung wird sicher dazu führen, dass die Betroffenen zweimal überlegen, bevor sie bei der Bank die Kosten der Hypothekenbeurkundung reklamieren, da die Urkundensteuer in der Regel 30 % bis 50 % dieser Kosten darstellt.
Allerdings ist dieses Thema hiermit noch nicht abgeschlossen, da verschiedene Verbände bereits angekündigt haben, dass sie die Gerichte der EU anrufen werden, so dass mit neuen Überraschungen gerechnet werden muss.

[value] => Hace unos meses comentábamos desde estas mismas páginas la Sentencia de la Sala 1ª (de lo Civil) Tribunal Supremo de 23 de diciembre de 2015, que declaraba nula, por abusiva, una cláusula contenida en un contrato de préstamo hipotecario en virtud de la cual el prestatario se obligaba a asumir todos los gastos de formalización del contrato de préstamo hipotecario, incluidos los gastos notariales, registrales y también el pago del Impuesto sobre Actos Jurídicos Documentados (IAJD).
En relación con dicho impuesto, la sentencia de la Sala 1ª generó cierta polémica, ya que entraba en contradicción con otras sentencias de la Sala 3ª (de lo contencioso-administrativo) del TS, que habían declarado anteriormente que la normativa tributaria dejaba claro que el sujeto pasivo del IAJD en los casos de constitución de una hipoteca en garantía de un préstamo es el prestatario, no el banco.
Recientemente la Sala 1ª ha vuelto a pronunciarse al respecto, abandonando la línea inicial contenida en la Sentencia del 2015 y compartiendo ahora las tesis de la Sala 3ª. En síntesis, en sus sentencias de 15 de marzo de 2018 (nº 147 y 148) viene a decir ahora el Supremo que, con independencia de que el pago del impuesto por el prestatario venga establecido en una cláusula abusiva, y por tanto, nula, lo cierto es que la normativa tributaria establece que el sujeto pasivo es el prestatario, por lo que será éste el que estará obligado en todo caso al pago del impuesto, en la forma establecida por la normativa del impuesto.
Esta nueva interpretación hará sin duda que los afectados se lo piensen dos veces antes de reclamar al banco los gastos de formalización de la hipoteca, ya que el importe correspondiente al pago del IAJD suele suponer entre un 30% y un 50% de todos los gastos de formalización.
No obstante, el asunto no acabará aquí, ya que ya se han anunciado desde diferentes asociaciones recursos ante los Tribunales de la UE, por lo que no cabe descartar nuevas sorpresas en el futuro.
