[value] => Diejenigen Unternehmen, die Ihre Mitarbeiter für Arbeiten nach Spanien für eine bestimmte Dauer entsenden, müssen diese vorher bei der spanischen Arbeitsbehörde anmelden. Die Pflicht zur Anzeige der Entsendung nach Spanien, die immer vor dem Beginn der Entsendung stattfinden muss, besteht ab dem 8. Kalendertag. Zu beachten ist, dass infolge der neuen Regelung des Königlichen Gesetzesdekrets 9/2017 der zwingende Inhalt der Entsendungsmitteilungen geändert wurde. Es wird nach wie vor verlangt, dass die Unternehmen folgende Daten angeben:
- Komplette Daten des Unternehmens und Ort, an dem das es seinen Sitz und Verwaltung hat;
- Daten des rechtlichen Vertreters;
- Ort, an dem die entsandten Arbeitnehmer eingesetzt werden und von dem aus sie entsandt werden sowie die genaue Anschrift des Arbeitsortes in Spanien;
- Art der auszuführenden Tätigkeiten;
- Voraussichtliche Dauer und geplantes Datum des Beginns und des Endes der Entsendung;
- Daten der entsandten Arbeitnehmer.
Zusätzlich werden seit dem Inkrafttreten des erwähnten Königlichen Dekrets folgende weiteren Pflichten festgelegt: a) Benennung eines Ansprechpartners, der bei Bedarf Dokumente und/oder Mitteilungen verschickt und entgegennimmt. b) Benennung einer Kontaktperson als Vertreter, durch den die einschlägigen Sozialpartner während des Zeitraums der Dienstleistungserbringung versuchen können, den Dienstleistungserbringer zur Aufnahme von Kollektivverhandlungen im Aufnahmemitgliedstaat gemäß dem nationalen Recht und/oder den nationalen Gepflogenheiten zu bewegen.
Die in der Mitteilung angegebenen Daten werden von den Arbeitsbehörden an die spanische Steuerbehörde, die Sozialversicherung, und die Arbeitsaufsicht weitergeleitet. Auf Anforderung und bei Kontrollen müssen die Unternehmen den spanischen Behörden jederzeit die ordnungsgemäße Erfüllung der Anzeigepflicht nachweisen können. Die Nichterfüllung der Verpflichtungen im Bereich der Entsendungen, können von den spanischen Behörden mit Geldbußen von 60.-€ bis 6.250.-€ (die Geldbuße kann aufgrund der Schwere des Verstoßes variieren) bestraft werden.

[value] => Las empresas que desplacen temporalmente a sus trabajadores a España para la prestación de sus servicios o actividades, tienen la obligación de comunicar previamente su desplazamiento a las Autoridades españolas. La comunicación deberá efectuarse de manera previa al desplazamiento y será siempre obligatoria, salvo que la duración del mismo no exceda de 8 días. Tras la entrada en vigor del Real Decreto 9/2017, se ha modificado el contenido de la comunicación de desplazamiento. Se exige que las empresas pongan a disposición de las Autoridades competentes la siguiente información:
- Datos de la empresa que desplaza;
- Datos de los representantes legales;
- Lugar y datos relativos a la empresa en la que se prestarán los servicios en España;
- Actividades que van a desarrollarse;
- Fecha de inicio y duración prevista;
- Datos de los trabajadores desplazados.
Tras la entrada en vigor del decreto antes mencionado, se establecen nuevas obligaciones que han de ser tenidas en cuenta a la hora de realizar la mencionada comunicación: a) Nombrar los datos identificativos de una persona física o jurídica presente en España que sea designada por la empresa como su representante para servir de enlace con las autoridades españolas y para el envío y recepción de documentos, de ser necesario, b) Nombrar los datos identificativos de una persona que pueda actuar en España en representación de la empresa en los procedimientos de información, consulta y negociación, que afecten a los trabajadores desplazados a España.
La Autoridad Laboral dará traslado de los datos reflejados en la comunicación a la Agencia Tributaria, a la Seguridad Social, así como a la Inspección de Trabajo. Cabe destacar que la Inspección de Trabajo podrá exigir a las empresas que justifiquen en cualquier momento que han realizado las correspondientes comunicaciones. Hay que señalar que el incumplimiento de las obligaciones empresariales en materia de comunicación de desplazamientos pueden ser sancionadas con multas, que pueden oscilar entre 60.-€ y 6.250.-€, (dependiendo del grado de incumplimiento).
