[value] => Das juristische Online-Magazin Legal Tribune Online (LTO) hat die sog. “Justizstatistik” für das Jahr 2016 veröffentlicht. Es handelt sich dabei um mehr oder weniger vertrauliche Übersichten der Justizministerien der Länder, die im Gegensatz zum EU-Justizbarometer (vgl. unseren Beitrag im AHK-Newsletter 04/2016) unter Verschluss gehalten werden sollen, aber über Umwege – wie beispielsweise Anfragen nach dem Informationsfreiheitsgesetz – doch an die Öffentlichkeit gelangen.
Die Zahlen aus dem Jahr 2016 legen nahe, dass insbesondere die Richter an den Zivilgerichten unter enormen Druck stehen. Die Fallzahlen unterscheiden sich dabei von Bundesland zu Bundesland. Das Bundesland Bremen ist in dieser Hinsicht Spitzenreiter. Dort musste ein Richter im Jahr 2016 insgesamt 444,3 eingehende Verfahren bearbeiten. In Sachsen waren es nur 315,3. Hohe Fallzahlen bedeuten hohen Druck und der führt augenscheinlich zu höheren Erledigungszahlen. Denn ein Bremer Richter erledigte 648,3 Fälle, während sein sächsischer Kollege nur 462,7 Akten ablegen konnte. Die Richter fast aller Bundesländer haben dabei eine Erledigungsquote, die über 100 Prozent liegt. Das ist darauf zurückzuführen, dass die Richter vieler Bundesländer mit hohen Beständen an alten Akten zu kämpfen haben.
Die Quote der Verfahren, die durch einen Vergleich erledigt werden konnte, lag übrigens zwischen 11,1 Prozent und 19,5 Prozent. Die Verfahrensdauer – Eingang bis Erledigung – lag zwischen 6,1 und 10,7 Monaten im Durchschnitt. Nach einhelliger Meinung von Fachzeitschriften, Blogs und sonstigen Kommentaren sagen aber weder Verfahrensdauer noch Erledigungszahl etwas über die Qualität der Verfahrensführung und der Entscheidung aus. Aussagekräftiges Kriterium dafür ist beispielsweise die Quote erfolgreicher Berufungen. Darüber sagt die Statistik nichts aus.

La revista jurídica online Legal Tribune Online (LTO) ha publicado las llamadas “estadísticas judiciales” del año 2016. A grandes rasgos, se trata de un resumen confidencial de los Ministerios de Justicia de los estados federados de Alemania, que, a diferencia del barómetro europeo de la justicia (ver nuestro artículo en el Newsletter 04/2016 de la AHK), debe mantenerse en secreto, pero que de manera indirecta – como p.ej. consultas previstas en la Ley de Libertad de Información - se filtra al público.
Las cifras del año 2016 ponen de manifiesto que, en particular, los jueces en los tribunales civiles están sometidos a una gran presión. El número de casos es diferente en función del estado federado. El estado de Bremen lidera este ámbito. Allí, tuvo que tramitar un juez en el año 2016 un total de 444,3 nuevos procedimientos. En el estado de Sajonia, sólo fueron tramitados 315,3. Un gran número de casos significa gran presión y conduce aparentemente a la finalización de un mayor número de procedimientos. Así, un juez de Bremen concluyó 648,3 casos, mientras que sus compañeros sajones sólo pudieron archivar 462,7 casos. Los jueces de casi todos los estados federados tienen una tasa de resolución superior al 100 %. Esto se debe al hecho de que los jueces de muchos estados federales tienen que lidiar con altos niveles de inventario de asuntos antiguos.
La cuota de procedimientos que fueron resueltos mediante acuerdo se situó entre un 11,5 % y un 19,5 %. La duración media de un procedimiento judicial -desde su inicio hasta su terminación- es de entre 6,1 y 10,7 meses. Sin embargo, de acuerdo con la opinión unánime de revistas especializadas, blogs y otros comentarios, ni la duración del procedimiento ni el número de casos resueltos dicen nada sobre la calidad del procedimiento y de la resolución. Un criterio a tener en cuenta a este respecto sería p.ej. la cuota de apelaciones exitosas. Sobre esta cuestión no dice nada la estadística.
