[value] => In seinem Beschluss vom 8. März 2018 zentriert sich das zentrale Finanzgericht in dem zum Zwecke der Vereinheitlichung des anzuwendenden Kriteriums geführten Beschwerdeverfahren, auf die Feststellung, ob das Verhalten eines Steuerpflichtigen, der in der Körperschaftsteuererklärung von 2012 negative Steuerbemessungsgrundlagen nachwies, welche in den Körperschaftsteuererklärungen von 2009 und 2010 im Wege einer Betriebsprüfung als rechtswidrig erklärt und entsprechend sanktioniert worden waren, Grund für eine erneute Ahndung darstellen kann oder nicht.
Hierfür prüfte das Gericht, ob die spanische Steuerbehörde gegen den Grundsatz ne bis in idem verstoßen hat, und danach, ob die Sanktion, sollte sie rechtmäßig sein, wegen der rechtswidrigen Akkreditierung der negativen Steuerbemessungsgrundlagen in der Selbstabführung von 2012 um die Höhe des Betrags der ersten Sanktion gemindert werden soll. Das Gericht befand, dass dieser Rechtsgrundsatz nicht verletzt wurde, da es sich um zwei voneinander unabhängige Rechtsverletzungen handelt.
In Bezug auf die zweite Frage, entschied das Gericht ebenso gegen den Antragsteller mit der Begründung, dass solch eine Minderung nur in Betracht käme, wenn er die rechtswidrig akkreditierten negativen Steuerbemessungsgrundlagen ausgeglichen hätte. Dann würde sich eine sich hiervon unterscheidende Rechtsverletzung ergeben, wie die Nichtabführung eines Teils der Steuerschuld, was hier nicht der Fall ist, da mit der zweiten Sanktion nicht deren tatsächliche Begleichung geahndet wird, sondern die rechtswidrige Akkreditierung.

[value] => Mediante Res. de 8 de marzo de 2018 dictada por el TEAC en recurso extraordinario de alzada para la unificación de criterio, el Tribunal se centra en determinar si la conducta de un obligado tributario que acreditó en la declaración del Impuesto sobre Sociedades, (IS) del ejercicio 2012 unas bases imponibles negativas, (BINS), que habían sido declaradas improcedentes y eliminadas por actuación inspectora realizada sobre las declaraciones del IS de 2009 y 2010, y por las que fue sancionado, es susceptible o no de ser nuevamente sancionada.
El Tribunal analiza, en primer lugar, si la Administración tributaria española ha vulnerado el principio de non bis in idem, para, en segundo lugar, analizar si en el caso de resultar conforme a Derecho imponer otra sanción, esta nueva sanción debería reducirse en el importe de la primera. Como es sabido, bajo el principio de non bis in idem, se impide sancionar al mismo sujeto por el mismo hecho con el mismo fundamento; pues bien, en el caso examinado, para el Tribunal no se aprecia vulneración alguna del citado principio, dado que aunque la infracción que se manifiesta en ambos procedimientos es la misma, esto es, la acreditación improcedente de las mismas BINS, en el segundo caso, el obligado tributario ya conocía la improcedencia de las bases y, no obstante, decidió incorporarlas en su declaración de 2012.
En el presente caso, para el Tribunal, no nos encontramos ante una misma infracción que pretende sancionarse dos veces, sino ante dos infracciones que pueden ser sancionadas independientemente. Respecto a la segunda de las cuestiones, resuelve también negativamente a los intereses del recurrente, en tanto entiende que solo procedería dicha minoración si estuviéramos en el supuesto de haber compensado efectivamente las BINS indebidamente acreditadas, resultando otra infracción distinta como sería la de haber dejado de ingresar parte de la deuda tributaria, lo que no resulta ser el caso.
