[value] => Der Gerichtshof der Europäischen Union (EuGH) hat in seinem Urteil vom 22. Februar 2018 entschieden, dass die spanischen Vorschriften, die eine Kündigung des Arbeitsverhältnisses einer schwangeren Arbeitnehmerin aufgrund einer Massenentlassung zulassen, nicht den europäischen Vorschriften widersprechen, soweit die Kündigungsgründe nicht mit dem Zustand der Arbeitnehmerin in Zusammenhang stehen und der Arbeitgeber schriftlich die berechtigten Gründe für die Kündigung anführt.
Im Jahr 2013 teilte Bankia, S.A. im Rahmen einer Massenentlassung einer schwangeren Arbeitnehmerin die Beendigung ihres Arbeitsvertrages infolge der Notwendigkeit von Personalanpassungen in der Provinz, in der die Arbeitnehmerin beschäftigt war, und aufgrund der niedrigen Punktzahl der Arbeitnehmerin in dem vom Unternehmen durchgeführten Bewertungsverfahren, mit. Die Arbeitnehmerin legte gegen die Kündigung Klage ein, da sie im Zeitpunkt der Mitteilung derselben schwanger war.
Der EuGH stellt jedoch fest, dass das spanische Recht, das die Kündigung von Schwangeren zulässt, soweit diese aus Gründen erfolgt, die nicht mit der Schwangerschaft im Zusammenhang stehen, im Einklang mit europäischem Recht steht. Der EuGH erkennt zwar das Verbot der Kündigung von Arbeitnehmerinnen während der Zeit vom Beginn der Schwangerschaft bis zum Ende des Mutterschaftsurlaubs an, davon ausgenommen sind jedoch “die nicht mit ihrem Zustand in Zusammenhang stehenden Ausnahmefälle, die entsprechend den einzelstaatlichen Rechtsvorschriften und/oder Gepflogenheiten zulässig sind.“ Die europäischen Vorschriften stehen daher nicht einer nationalen Regelung entgegen, nach der das Unternehmen einer schwangeren Arbeitnehmerin im Rahmen einer Massenentlassung kündigen kann, soweit “der Arbeitgeber schriftlich die Gründe, die die Massenentlassung rechtfertigen und nicht in der Person der Arbeitnehmerin liegen, darlegt.” Zudem muss der Arbeitgeber der schwangeren Arbeitnehmerin die sachlichen Kriterien für die Auswahl der zu entlassenden Arbeitnehmer angeben.

[value] => El 22 de febrero de 2018, el Tribunal de Justicia de la Unión Europea (TJUE) dictó una sentencia en la que considera que la ley española, que ampara la terminación de la relación laboral de una trabajadora durante el embarazo mediante despido colectivo, no es contraria a la normativa europea, siempre y cuando las razones que motiven la extinción no estén relacionadas con el embarazo y el empresario comunique por escrito los motivos que la justifican.
En 2013, en el marco de un despido colectivo, Bankia, S.A. notificó a una empleada embarazada la extinción de su contrato de trabajo, como consecuencia de la necesidad de un reajuste de la plantilla en su provincia y dado los bajos resultados de la trabajadora en el proceso de valoración realizado por la empresa durante el periodo de consultas. La empleada impugnó el despido alegando que estaba embarazada en el momento de la comunicación del mismo.
No obstante, el TJUE entiende que la normativa española, que permite la posibilidad de despedir a una embarazada, siempre y cuando la decisión extintiva no guarde relación con el embarazo, no es contraria al derecho europeo. El TJUE reconoce que la normativa europea prohíbe el despido de trabajadoras durante el periodo comprendido entre el comienzo del embarazo y el final del permiso de maternidad, “salvo en casos excepcionales no inherentes a su estado admitidos por las legislaciones y/o prácticas nacionales”. No obstante, no se opone a una normativa nacional que permita el despido de una trabajadora embarazada con motivo de un despido colectivo, siempre que “el empresario comunique por escrito los motivos justificados del despido, no inherentes a la persona de la trabajadora.” Asimismo, el empresario debe indicar a la embarazada cuáles son los criterios objetivos seguidos para la designación de los trabajadores afectados por el despido. Por lo anterior, la normativa española, y por ende, un despido efectuado en base a ella, se ajustan al derecho europeo, siempre que se indiquen los motivos antes mencionados.
