[value] => Bereitschaftsdienste, bei denen der Arbeitnehmer in kürzester Zeit zur Verfügung stehen muss, zählen als Arbeitszeit - auch wenn die Bereitschaft zu Hause abgeleistet wird. Dies entschied der Europäische Gerichtshof (EuGH) im Falle eines belgischen Feuerwehrmanns.
Nach Auffassung der Richter ist auch eine passive “Rufbereitschaft“ Arbeitszeit i.S.d. Arbeitszeitrichtlinie, sofern dem Arbeitnehmer zeitliche und/oder geografische Vorgaben gemacht werden, die ihn darin einschränken, sich seinen persönlichen und sozialen Interessen zu widmen. Dies sei bei der Verpflichtung des betroffenen Feuerwehrmanns, sich innerhalb von acht Minuten am Arbeitsort einzufinden, zweifelsfrei der Fall. Muss der Arbeitnehmer während seines Bereitschaftsdienstes lediglich für seinen Arbeitgeber erreichbar sein, sei der Fall anders zu beurteilen, so die Richter.
Damit setzt der EuGH seine bisherige Rechtsprechung zur Abgrenzung von Arbeits- und Ruhezeiten fort und spiegelt auch die Auffassung der deutschen Arbeitsgerichte wider.
Nach deutschem Recht ist Rufbereitschaft nicht Arbeitszeit (§§ 2, 5 ArbZG), sondern Ruhezeit, die der Arbeitnehmer zwischen der Arbeit zur Verfügung haben soll, um sich zu erholen. Umfasst von der Rufbereitschaft in Deutschland ist jedoch auch nur die Pflicht des Arbeitnehmers, außerhalb der Arbeitszeit auf Abruf die Arbeit aufzunehmen, währenddessen jedoch frei über seinen Aufenthaltsort bestimmen zu können. Ist dies nicht möglich und muss er sich innerhalb kürzester Zeit am Arbeitsplatz einfinden, sind solche „Bereitschaftsdienste“ auch nach deutschem Recht Arbeitszeit.
Zur Frage inwiefern Bereitschaftsdienste entlohnt werden müssen, hat der EuGH nicht entschieden, da hier nationale Regeln ausschlaggebend seien.
In Deutschland müssen Bereitschaftsdienste mit dem Mindestlohn vergütet werden. Dies bedeutet allerdings auch, dass wenn die übliche Vergütung höher als der Mindestlohn ist, die Bezahlung für Bereitschaftsdienste niedriger ausfallen kann. Im Fall des Feuerwehrmannns hat nun das Gericht in Brüssel darüber zu entscheiden.

[value] => Las guardias domiciliarias que obligan al trabajador a responder de forma inmediata y permanecer a disposición de sus jefes para prestar un servicio deben considerarse como tiempo de trabajo, incluso, si la guardia se realiza en casa. Esta fue la decisión del Tribunal Europeo de Justicia (TJCE) con el caso de un bombero belga.
Según los jueces, el “servicio de guardia” pasivo también es tiempo de trabajo en el sentido de la Directiva sobre el tiempo de trabajo, siempre que se le indiquen al empleado los detalles temporales y/o geográficos que le restringen a la hora de dedicarse a sus intereses personales y sociales. Ese fue el caso respecto a la obligación del bombero de llegar al lugar de trabajo en máx. 8 minutos. Dicen los jueces que si el empleado durante su tiempo de guardia tiene que estar generalmente disponible para la empresa, el caso debe ser juzgado de manera diferente.
Con ello, el TJCE continúa su jurisprudencia anterior sobre la delimitación de los períodos de trabajo y descanso, a la vez que confirma las sentencias de los tribunales laborales alemanes.
De acuerdo con la ley alemana, el servicio de guardia general no se considera tiempo de trabajo efectivo (§§ 2, 5 ArbZG), sino tiempo de descanso que el empleado debe tener entre jornadas para recuperarse. Sin embargo, en Alemania, durante el servicio de guardia general, el trabajador que debe estar a disposición de la empresa tiene libertad para elegir su paradero. Si no fuera posible y tuviera que llegar al lugar de trabajo en muy poco tiempo, tales “guardias domiciliarias” se califican como horas laborables, según la ley alemana.
El TJCE no se ha pronunciado sobre la retribución de los trabajadores por ese tiempo de trabajo, ya que las normas nacionales lo determinan.
En Alemania, las guardias domiciliarias deben ser remuneradas con el salario mínimo. Sin embargo, esto también significa que si la compensación habitual es más alta que el salario mínimo, el pago por las guardias domiciliarias puede ser menor. Esperemos a que el tribunal en Bruselas se decida en el caso del bombero.
