[value] => Der Bundesfinanzhof geht für Zwecke der Einkommensteuer davon aus, dass bei beherrschenden Gesellschafter-Geschäftsführern ein steuerpflichtiger Zufluss von Einnahmen (§ 11 EStG) auch ohne Zahlung oder Gutschrift vorliegen kann. Danach fließt dem beherrschenden Gesellschafter eine eindeutige und unbestrittene Forderung gegen eine von ihm beherrschte Kapitalgesellschaft bereits mit deren Fälligkeit zu, denn ein beherrschender Gesellschafter hat es regelmäßig in der Hand, sich geschuldete Beträge auszahlen zu lassen, wenn der Anspruch eindeutig, unbestritten und fällig ist. Von dieser Zuflussfiktion werden Gehaltsbeträge und sonstige Vergütungen erfasst, die die Kapitalgesellschaft dem sie beherrschenden Gesellschaftern schuldet und die sich bei der Ermittlung des Einkommens der Kapitalgesellschaft ausgewirkt haben. Nach Auffassung der Finanzverwaltung soll es hierfür schon ausreichen, dass die Verbindlichkeit auf Seiten der GmbH nach den Grundsätzen ordnungsgemäßer Buchführung hätte gebildet werden müssen (vgl. BMF-Schreiben vom 12. Mai 2014 IV C 2-S 2743/12/10001).
In einem jüngst veröffentlichten Urteil vom 15.11.2017 (9 K 1016/14) hat das Finanzgericht Köln entschieden, dass diese Zuflussfiktion im Umsatzsteuerrecht nicht gilt. Versteuert daher beispielsweise ein freiberuflich tätiger Ingenieur, der mehrheitlich an einer Ingenieurs-GmbH beteiligt und bei dieser als Geschäftsführer bestellt ist, die an diese fakturierten Honorare auf Antrag nach vereinnahmten Entgelten (§ 20 UStG), so wird die in Rechnung gestellte Umsatzsteuer erst dann fällig, wenn dieser für seine Leistung eine Gegenleistung in Geld oder Geldeswert erhält, über die er wirtschaftlich verfügen kann. Denn durch den unionsrechtlichen Begriff der Vereinnahmung (Art. 66 MwStSystRL) sollte der Zeitpunkt, zu dem die Steuerschuld in allen EU-Mitgliedstaaten entsteht, harmonisiert werden, aufgrund von nationalen Rechtsinstituten könne dieser nicht modifiziert werden.
Die Richtigkeit dieser Sichtweise wird der Bundesfinanzhof im anhängigen Revisionsverfahren prüfen (BFH XI R 39/17).

[value] => A efectos del Impuesto sobre la Renta de las Personas Físicas, el Tribunal Federal Supremo de lo Fiscal parte de la base de que el socio dominante que a su vez es administrador de la sociedad puede tener una percepción de ingresos sujeta a imposición (§ 11 LIRPF alemana), también sin que medie pago o abono alguno. Así, el socio dominante posee un crédito definido y no impugnado con vencimiento frente a la sociedad de capital dominada por él, pues él normalmente puede decidir el pago a sí mismo de las cantidades debidas cuando la pretensión sea evidente, no impugnada y vencida. En esta ficción de percepción de ingresos se incluyen los importes del salario y de otras retribuciones, que la sociedad de capital deba al socio dominante y que se hayan visto afectadas en el cálculo de los ingresos de la sociedad de capital.
Según la Administración Tributaria debería ser suficiente para este efecto que la obligación por parte de la Sociedad Limitada alemana (“GmbH”) se hubiera tenido que contemplar de conformidad con los principios de una adecuada contabilidad (véase circular del Ministerio Federal de Finanzas (BMF) de 12 de mayo de 2014 IV C 2-S 2743/12/10001). En una sentencia de fecha 15/11/2017 (9 K 1016/14) recién publicada, el Tribunal de lo Fiscal de Colonia decidió que esta ficción de percepción no es aplicable a los efectos del IVA. Por tanto, si por ej. un ingeniero autónomo que posee una participación mayoritaria en una GmbH de ingeniería y que ha sido nombrado como administrador de la misma, ha solicitado tributar por los honorarios facturados en aplicación del criterio de caja (§ 20 LIVA alemana), el IVA será exigible cuando éste reciba por los servicios prestados una contraprestación en dinero o en valor monetario sobre la que él pueda disponer económicamente.
El Tribunal Federal Supremo de lo Fiscal comprobará la certeza de este punto de vista en un procedimiento de revisión (BFH XI R 39/17).
