[value] => Die EU-Datenschutz-Grundverordnung (DSGVO) wird in Kürze anwendbar sein (ab dem 25. Mai 2018). Dadurch wird nunmehr in der gesamten Europäischen Union ein einheitliches Datenschutzrecht gelten. Ähnlich wie bisher in Deutschland, wird die Erfassung, Verarbeitung und Speicherung von personenbezogenen Daten nur mit der ausdrücklichen Einwilligung der betroffenen Person zulässig sein.
Die DSGVO zielt darauf ab, dass personenbezogene Daten nur bei Notwendigkeit und einem eindeutig festgelegten Zwecks erhoben werden dürfen (Grundsätze der Datenminimierung und Zweckbindung). Daneben gelten die Grundsätze der Rechtmäßigkeit, Verarbeitung nach Treu und Glauben und der Transparenz. Besonderes Augenmerk ist in Zukunft den Formalitäten für eine wirksame Einwilligung des Betroffenen zu schenken. Um spätere Missverständnisse und Unwirksamkeitsrisiken zu vermeiden, sollte die Einwilligung – wenn möglich - in einem separaten Dokument oder jedenfalls deutlich von den übrigen vertraglichen Regelungen abgesetzt, dokumentiert werden. Die Einwilligung Minderjähriger ist bei Online-Diensten grundsätzlich ab dem 16. Lebensjahr wirksam.
Erhöhte Anforderungen stellt die Verordnung für besonders sensible personenbezogene Daten auf, aus denen sich bspw. auf die rassische und ethnische Herkunft, politische Meinungen, religiöse oder weltanschauliche Überzeugungen oder die Gewerkschaftszugehörigkeit einer Person schließen lässt oder wenn es um die Verarbeitung von genetischen oder biometrischen Daten, Gesundheitsdaten oder Daten zum Sexualleben oder über die sexuellen Orientierung geht. In diesen Fällen ist eine Verarbeitung der Daten untersagt, sofern nicht ein ausdrücklich genannter Ausnahmetatbestand verwirklicht ist. Die DSGVO führt ausdrücklich das “Recht auf Vergessenwerden“ ein, wodurch in Zukunft die Löschung nicht mehr benötigter Daten auf Antrag des Betroffenen auch gerichtlich ohne weiteres durchsetzbar sein wird.

[value] => El Reglamento General de Protección de Datos (RGPD) comenzará a aplicarse a partir del 25 de mayo de 2018. Así, la protección de los datos de carácter personal quedará regulada de manera uniforme en toda la UE. Al igual que sucedía en Alemania, la recopilación, el procesamiento y el almacenamiento de datos personales sólo se permitirá con el consentimiento expreso del interesado.
El RGPD tiene por objeto garantizar que los datos personales sean recopilados únicamente en caso de que sea necesario y para fines claramente definidos (principios de minimización en la recogida de datos y de limitación a una finalidad específica). Además, se aplicarán los principios de legalidad, de tratamiento lícito y leal de datos y de transparencia. En el futuro, deberá prestarse especial atención a las formalidades necesarias para garantizar el efectivo consentimiento de las personas afectadas. Para evitar malentendidos y riesgos de ineficacia, el consentimiento debe otorgarse, siempre que sea posible, en un documento separado o al menos claramente separado de las demás disposiciones contractuales. El consentimiento de los menores de edad a través de medios electrónicos se considerará válido a partir de los 16 años.
El Reglamento establece requisitos más estrictos para datos personales que, por su naturaleza, son particularmente sensibles, entre los que se incluyen, a modo de ejemplo, los datos de carácter personal que revelen el origen racial o étnico, opiniones políticas, convicciones religiosas o filosóficas o la pertenencia a un sindicato o con respecto al tratamiento de datos genéticos o biométricos, datos relativos a la salud o datos relativos a la vida sexual o las orientación sexuales. En estos casos, el tratamiento de estos datos personales está prohibido, salvo que se manifieste explícitamente una exención de esta prohibición. El RGPD introduce expresamente «el derecho al olvido», con lo cual en el futuro se podrán suprimir, a instancia del interesado y sin mayor dilación, aquellos datos que ya no sean necesarios, también judicialmente.
